Summary: Ms D complained the Council failed to adhere to the statutory timescales for the Education, Health and Care need assessment process for her child (X). She said, as a result, they experienced distress and X had a loss of education. The Council accepted it caused a service failure as it was responsible for the delay due to a shortage of educational psychologists. The Council agreed to apologise and provide a proportionate remedy to acknowledge the injustice this caused. However, we could not say the Council’s delay caused X a loss of education.

Summary: The Council was at fault for delays in issuing Y’s EHC Plan following the 2025 annual review, for failing to issue an appealable decision following the 2024 annual review and for failing to consider its Section 19 and 42 duties between September 2025 and February 2026. The faults caused Ms X and Y uncertainty and led to Y missing two terms of education and the specialist provisions from their existing EHC Plans. The Council agreed to apologise and make payments to remedy the injustice caused.

We find the Council at fault for its delays in finalising Miss X’s son’s Education, Health and Care Plan. It was also at fault for its delay in finding a specialist setting and for its communication with Miss X. The Council’s faults caused Miss X distress and frustration, and Miss X’s son lost out on special educational provision. The Council has agreed to apologise to Miss X and make a payment to her.
