The Council has apologised and offered a suitable payment to reflect Ms X’s avoidable distress, time and trouble and delay in appeal rights.

We find the Council at fault for not putting up a site notice to publicise the application, which caused no injustice, and no fault with the Council’s decisions to approve the applications.

The Council has agreed to apologise, make a symbolic payment to Mr B, assess his application and, if he qualifies to join the register, backdate his registration and award date.
