Summary: Ms X complained that although she should receive assisted collections the Council has repeatedly failed to collect her household waste as scheduled. Ms X also complained that when the Council does empty her bin, it does not also take the accumulated side waste and clinical waste and has refused her request for an additional bin. We found the failure to collect Ms X’s waste in line with the assisted collection service is fault, as was the failure to consider her requests for an additional bin. These faults have caused Ms X an injustice.

Summary: Mrs B complained that the Council had failed to ensure the provision in her daughter, C’s Education, Health and Care Plan was in place and failed to ensure C received a full-time education when she was unable to attend school. Based on current evidence we have found some fault in the actions of the Council. The Council has agreed to apologise to Mrs B and C, make a symbolic payment and review its procedures for the future.

Summary: Mrs X complained that the Council delayed arranging an annual review for her child, B’s, Education Health and Care Plan. She said it failed to communicate adequately and did not make timely or effective efforts to secure a suitable school placement. We found the Council at fault for delays in the EHC review process. The Council agreed to apologise to Mrs X and make a payment in recognition of B’s loss of education, as well as the uncertainty and frustration caused by the delays and poor communication.

Summary: We find the Council was at fault for the delay in issuing a final Education Health and Care (EHC) Plan for Ms X’s son, Y. This caused Ms X distress and delayed her right to appeal. The Council also failed to give Ms X the information she needed to make an informed choice about whether to commission a private educational psychologist assessment for Y’s EHC assessment. This meant Ms X paid for the assessment unnecessarily. The Council’s communication with Ms X was also poor. The Council has agreed to apologise, makes symbolic payments and reimburse the cost of the private report to remedy the injustice caused to Ms X.

Summary: Ms Y complains the Council did not take appropriate action when her child, D, stopped attending school. She also complains there was a delay in reviewing and amending D’s Education, Health and Care Plan. In response to our enquiries, the Council has accepted fault and that this caused an injustice to Ms Y and D. It has proposed a remedy which is appropriate. We do not recommend anything further.

Summary: Mr X complained about the Council’s refusal to progress his complaint to stage two of the statutory children’s complaints procedure and respond to his later complaint about housing. We found the Council to be at fault because it took nine months to acknowledge his later complaint, despite Mr X sending several reminders. This caused Mr X significant frustration and distress. To remedy this injustice, the Council agreed to apologise and make a symbolic payment. We did not find fault with the Council’s initial decision to not proceed with the statutory procedure.

Summary: There was fault by the Council. The planning report for a planning application for a petrol filling station failed to record consideration of the noise impact and hours of operation. On the balance of probabilities, this fault has not affected the outcome of the planning application but has caused distress and uncertainty to Mr X. An apology and symbolic payment remedies the injustice caused.

Summary: Miss X complained the Council failed to secure the special educational provision set out in Section F of her child, Y’s Education, Health and Care Plan or provide a suitable alternative educational placement. We found the Council at fault for failing to maintain oversight of Y’s reduced timetable, failing to ensure and evidence delivery of all Section F provision, and delay in consulting alternative placements once it became clear attendance would not increase as planned. These failings led to missed education and special educational provision, uncertainty about Y’s long-term schooling, and distress. The Council has agreed to apologise, make a payment to Miss X, and share an update on finding a suitable placement.

Summary: We will not investigate Mr X’s complaint about the Council providing homelessness support as a loan because we have previously considered that issue. The new issues complained about have not caused Mr X a sufficient injustice to justify our involvement.

Summary: Mr B complained about the way an NHS Trust and a Council planned his mother’s, Mrs Z’s, discharge from hospital. We have not found fault in the way the organisations considered Mrs Z’s capacity or how they planned where she should be discharged to for further assessments. And we have not found fault in the way the Trust communicated with the placement about the equipment Mrs Z needed, or the way it communicated with the family about when Mrs Z would leave hospital.
