Summary: Ms Y complains about the Council’s failure to arrange suitable special educational provision once she moved into the area with her child, who we will call D. We find fault with the Council because it delayed when arranging provision. The provision eventually put in place did not meet D’s needs as set out in their Education, Health and Care (EHC) plan. The Council will make a symbolic payment to remedy the effects of the missed provision.

Summary: We will not investigate this complaint about alternative educational provision for Ms X’s child in the period September 2023 to January 2025. Part of the complaint is late, and we cannot investigate matters after Ms X used her right of appeal to the Special Educational Needs a Disability Tribunal. The period remaining between the two is short and there is not enough evidence of fault by the Council in that time to warrant investigation by us.

Summary: We found fault by the Council on Mr Y’s complaint about it failing to promptly act on his reports of serious disrepairs and hazards in his privately rented home. The Council delayed dealing with his reports, as well as delayed checking, inspecting, and carrying out a Housing Health and Safety Rating System assessment of the property sooner than it did. It also failed to take formal enforcement action when it found a category 1 hazard. The Council agreed to apologise, make a symbolic payment, and provide training and guidance to relevant officers.

Summary: We found fault with the Council for delays in completing a financial assessment of Mrs Z and providing information about the monetary cost of her care. We also found fault with the Council failing to suitably explain its deprivation of assets decision to Mr X. The Council agreed to apologise to Mr X, make a symbolic payment for the distress and uncertainty caused and provide an explanation of its rationale behind its deprivation of assets decision. The Council also agreed to create an action plan to address inconsistencies with its approach and record keeping over deprivation of assets decisions. The Council also offered to remove Mrs Z’s care home costs from when she entered the home in 2023 to 23 September 2023 which I consider suitable action to address the Council’s fault.

Summary: We will not investigate Mr X’s complaint about the Council not allowing him to have a vehicle crossover at his property and it not dealing with parked vehicles in his road overhanging the pavement. There is not enough evidence of fault by the Council in its crossover decision nor its response to the parking issue to warrant us investigating. There is insufficient injustice to Mr X caused by the parking matter to justify an investigation. We also cannot achieve the outcome Mr X seeks.

Summary: We will not investigate this complaint about the education offered to Mrs X’s child between April 2023 and July 2024. The complaint about the period before May 2024 is late, and there is no good reason to exercise discretion to investigate it now. Mrs X had already declined an offer of education at home, and the potential injustice caused by inadequate provision on days after May 2024 when the child attended the named school is limited. Investigation by us of these limited matters in a short period would be unlikely to lead to any worthwhile outcome.
