    Statement Upheld Noise 31-Jul-2024

Summary: Mr X says the Council has failed to deal with his complaints of noise from a nearby club. He says this caused him and his family distress. We have found fault in the actions of the Council for failing to issue a decision on the noise complaint and the Council has agreed to apologise to Mr X.

  • London Borough of Barking & Dagenham (23 016 569)

Statement Closed after initial enquiries Parking and other penalties 31-Jul-2024

Summary: We will not investigate Mr X’s complaint about the Council’s refusal to redesign a pathway providing vehicular access to his property. This is because it is unlikely we could achieve any worthwhile outcome for Mr X.

  • Wokingham Borough Council (23 016 622)

Statement Not upheld Assessment and care plan 31-Jul-2024

Summary: We will not investigate Mrs X’s complaint about the Council not sharing relevant information with care homes when sourcing a placement for her father. She says this led to care homes that were unsuitable offering him a place and forced the family to pay a top up fee to enable her father to attend the family’s preferred care home. This is because there is insufficient evidence of fault.

Statement Upheld Special educational needs 31-Jul-2024

Summary: Ms X complained about delays in issuing an Education, Health and Care Plan. This was due to a shortage of educational psychologists. This is fault. The Council has agreed to make a payment to Ms X to recognise the injustice.

  • London Borough of Lambeth (23 017 443)

Summary: We will not investigate this complaint about a housing application. This is mainly because there is not enough evidence of fault in the Council’s handling of the application.

  • London Borough of Redbridge (23 017 783)

    Statement Upheld Allocations 31-Jul-2024

Summary: Ms X complained the Council failed to rehouse her, despite her home being unsuitable for her family’s needs. We find the Council at fault for delays in dealing with Ms X’s medical assessment. We have not asked the Council to provide a remedy as there is no significant injustice.

  • Salford City Council (23 018 129)

Statement Closed after initial enquiries Other 31-Jul-2024

Summary: We will not investigate Ms X’s complaint about the Council failing to ask her for relevant information which she considers would have affected her welfare benefit claims. This is because the actions complained about are not the administrative function of a council.

  • Essex County Council (23 018 366)

Statement Upheld Special educational needs 31-Jul-2024

Summary: Mrs X complained about the Council’s delays in the Annual Review of her daughter’s (Y) Education Health and Care Plan and the Council’s failing to provide Y with suitable education for many months. We found fault with the Council. We also found fault with the way the Council dealt with Mrs X’s complaint. The Council’s fault caused injustice to Y and Mrs X. The Council has already accepted its fault and offered some remedies. We accept most of the remedies offered by the Council. The Council has now agreed a higher payment to recognise the injustice caused to Y be the Council’s failings within its alternative provision duty.

  • Sunderland City Council (24 002 533)

Statement Closed after initial enquiries Traffic management 31-Jul-2024

Summary: We will not investigate Mr X’s complaint about the lack of suitable disabled parking spaces within a reasonable distance of the Council’s City Hall. This is because we are unlikely to find evidence of fault by the Council sufficient to warrant an investigation.

  • Gateshead Metropolitan Borough Council (24 002 689)

Statement Closed after initial enquiries Councillor conduct and standards 31-Jul-2024

Summary: We will not investigate this complaint about the Council’s failure to complete an assessment of a complaint about the conduct of a councillor. We consider that further investigation would not lead to a different outcome.
