Summary: Miss X complained about the Council’s handling of her care and support needs. We do not find fault in how the Council assessed and met Miss X’s needs, contributed to decisions on her housing situation, responded when her care ended, or in its general communication. We do find fault in the Council’s failure to inform Miss X of changes to her support arrangements in April 2024 and in its initial complaint response, which did not accurately explain what had occurred. However, these faults did not cause Miss X a significant injustice, and no remedy is required.

Summary: There was service failure by the Council in failing to provide a school place, or alternative provision outside the home, when a child with an Education, Health Care (EHC) Plan moved into its area. There was also fault in failing to consult independent specialist placements, failing to review the Plan and failing to consider the full range of support available to families with disabled children. Y missed out on education, social and leisure opportunities for two terms, speech therapy for three terms and Y’s parents had to take on additional caring responsibilities. The Council has agreed to make a symbolic payment to acknowledge the injustice caused, to review the Plan, and make service improvements.

Summary: Miss X complained the Council failed to properly support her homelessness application after she received a Section 21 notice from her landlord. The Council failed to properly assess if it was reasonable for Miss X to remain in the property and delayed progressing the prevention duty to the relief duty. This is fault and caused undue distress, uncertainty and time and trouble to Miss X. She also incurred court costs as a result of the Council’s delays. The Council agreed actions to remedy the injustice.

We have ended our investigation of the complaint because: the main part is linked to Mrs Y’s disagreement about the educational placement, special educational needs and provision in her child’s Education Health and Care Plan raised as matters in her appeal to the Tribunal; and the other parts are late.

Summary: Mr X complained about the Council’s handling of his child’s Education, Health and Care (EHC) Plan. We find the Council at fault for failing to complete the EHC Plan within statutory timescales. This caused Mr X avoidable stress and uncertainty and delayed his child’s access to special educational provision. The Council will apologise to Mr X, make a payment and update us on the steps it is taking to address delays in issuing EHC Plans.

Summary: There was fault with the way the Council considered Ms Y’s homelessness and housing register applications. This meant she had to wait longer to receive a housing register decision and homelessness assistance. There was no fault with how the Council considered Ms Y’s application for discretionary housing payment. The Council agreed to apologise and make a payment to Ms Y for the distress and anxiety caused.

Summary: We will not investigate this complaint about the Council’s actions in relation to trees outside Mr X’s property. This is because we are unlikely to find fault. It would be reasonable for the complainant to pursue any claim for property damage in court.

We found the Council at fault for delays, causing significant frustration, distress and uncertainty. The Council has agreed to apologise and pay a symbolic payment to recognise the injustice caused.
