There was fault in the way the Council delayed issuing remedial notices and communication and complaint handling was poor. This frustrated Mr and Ms X. The Council has already apologised but also agreed to make a financial payment.

Summary: Ms X complained about the Council’s handling of her child’s Education, Health and Care (EHC) needs assessment and the alternative provision arranged while her child was out of education. We have not investigated her complaint about the content of the EHC Plan because she has a right of appeal to the Tribunal. We do not find fault in the alternative provision arranged by the Council, but we do find fault in its failure to inform Ms X of her right to request a personal budget which resulted in a lost opportunity for Ms X to consider whether to make such a request. The Council has agreed to apologise to Ms X.

Summary: Ms B complained that the Council offered her temporary accommodation it knew to be unsuitable, delayed in carrying out a suitability review and failed to deal with her complaints properly. We found fault with the Council’s actions which meant Ms B lived in unsuitable accommodation for five months longer than necessary. We have asked the Council to apologise to Ms B and make a symbolic payment to her. It has already improved its procedures for the future.

Summary: Miss Y complained the Council delayed progressing her daughter’s care and support, failed to implement adequate provision, and did not provide her with appropriate carer support. We find fault in the delay in completing the assessment and progressing matters, but we do not find fault in the Council’s inability to provide services or respite where her daughter declined support. The delay caused frustration and uncertainty to Miss Y, but did not result in a loss of care provision to Miss X. The Council’s apologies and allocation of a new social worker provide a proportionate remedy for the injustice identified.
