    Summary: Ms C complains the Care Provider, acting for the Council and ICB, failed to provide satisfactory care to Mrs D which resulted in her not receiving suitable health care and support. Ms C also complains the Council failed to investigate the Care Provider through safeguarding properly. There was service failure by the Care Provider which has caused uncertainty about whether Mrs D received suitable care and support. The Council, and Care Provider have agreed to make service improvements and a symbolic payment to Ms C for the distress caused by the service failure.

    Summary: We found fault on Miss Y’s complaint against the Council about it failing to monitor her son’s provision in his Education, Health and Care plan while out of school. It failed to show when it actioned the need for an Occupational Therapist assessment. It also failed to deal with her complaints as required by its complaints procedure. The Council agreed to make a symbolic payment to her, send an apology, ensure proper records are kept, carry out a review, and remind officers about the need to respond fully to our enquiries. There was no fault on her complaint about it failing to provide appropriate education.

    Summary: Ms X complained about a delay in reinstating direct payments and providing care, and a delay in making adaptations to her home that were required as a result of a disability. She also complained about the Council not sharing documents and keeping her up to date appropriately. We found there was delay in meeting care needs and arranging adaptations and fault in communication and sharing of information. We also found the Council failed to properly have regard for its Equality Act duties when Ms X asked for reasonable adjustments. We recommended an apology a distress payment and a review of what reasonable adjustments Ms X needed.

    Summary: Mrs X complained about the Council’s actions when her relative, Mr Y, left supported living accommodation. We found fault because the Council did not make it clear when the search for new accommodation would begin or communicate effectively with Mrs X overall. This caused Mrs X avoidable distress and uncertainty and meant Mr Y was unsure when the search for accommodation would begin. To remedy the injustice caused, the Council will apologise to Mrs X and Mr Y and make a symbolic payment to her.

    Summary: There was fault in the way the Council applied the section 117 process which caused significant financial injustice to the late Mrs X and as a result to her family through the loss to her estate. The Council has put in place training to improve the knowledge of this legislation and accepts it should repay the care home fees incorrectly incurred.

    Summary: Miss X complained the Council failed to ensure her child, Y received a suitable education or the specialist provision in their Education, Health Care (EHC) Plan when they stopped attending school. The Council was at fault for failing to provide a suitable full-time education or the specialist provision in line with their EHC Plan between January 2025 and May 2025. The Council agreed to apologise to Miss X and make a payment to her to recognise Y’s missed education and for the distress and uncertainty caused.

    Summary: The Council failed to consider whether Mrs X had suffered an injustice because of issues with a nursery provider’s charging policy, failed to carry out an audit and failed to put Mrs X’s complaint through its complaints procedure. An apology, payment to Mrs X and an audit of the nursery provider to establish whether it is complying with government guidance is satisfactory remedy.
