Summary: We partially upheld a complaint from Mrs B about care provided to her mother, Mrs C, by the Care Provider. We found fault in the Care Provider’s record keeping around cuts and other wounds Mrs C sustained while living in one its care homes. We also raised concerns about the procedure followed by the Care Provider when it gave Mrs C notice to leave the care home. While Mrs C subsequently died, we considered these faults caused injustice to Mrs B as distress. So, we recommended action we wanted the Care Provider to take to remedy that injustice and improve its service for others. The Care Provider said it agreed our recommendations.

Summary: We cannot conclude, on the available evidence, the Council failed to meet the statutory requirements to publicise a planning application, but it was at fault for not keeping a photograph of a site notice, in accordance with its procedures. This did not cause an injustice to the complainants. There was no fault in how the Council validated or considered the application. We have therefore completed our investigation.

Summary: There was fault by the Council in failing to have oversight of alternative education when a pupil was severely absent over an extended period. This casts doubt on whether the education offered was suitable. It is too speculative to say whether, but for this fault, the pupil would have been able to engage in more education. This uncertainty is an injustice. The Council will apologise, make a symbolic payment to acknowledge the distress and uncertainty, and carry out service improvements.

Summary: Mrs X complained the Council reneged on a promise to waiver costs incurred for her mother’s care in the period before it decided her financial assessment. We do not find the Council at fault for charging for Mrs X’s mother’s care for this period. This is because its decision is in keeping with the relevant statutory guidance. We did find fault by the Council because it raised Mrs X’s expectations that it would not charge her for her mother’s care costs for this period. This caused Mrs X avoidable distress and uncertainty. The Council agreed to apologise and make Mrs X a symbolic payment.

Summary: Miss X complained on behalf of her grandmother and her family. She complained the Council failed to carry out proper assessments to establish her grandmother’s mental capacity and care needs. She also complained it did not complete carers’ assessments for members of Mrs Y’s family. We found fault by the Council on all matters. The Council agreed to apologise and make a symbolic payment to Mrs Y and her family in recognition of the injustice caused to them.

Summary: Mrs X complained the Council incurred delays following her request for an Education, Health and Care needs assessment for her son. She also complained the Council failed to provide alternative educational provision when her son was unable to attend school. Mrs X says the Council’s actions caused significant, avoidable anxiety and led to her son falling behind academically. We found fault by the Council. The Council has agreed to provide an apology and a financial remedy to address the injustice identified.
