    Summary: Mrs X complained the Council failed to safeguard Miss Y from financial abuse, and a social worker inappropriately talked Miss Y out of appointing a Lasting Power of Attorney for her finances. Mrs X also complained Miss Y’s care provider did not provide the support detailed in her care plan. We did not find fault in the support Miss Y received from her social worker and care provider. We discontinued our investigation into how the Council safeguarded Miss Y from financial abuse.

    Summary: Miss X complained about the Council’s failure to provide care and support for her brother, Mr Y, over a prolonged period. We found the Council to be at fault. To remedy the personal injustice caused by this fault, we recommend the Council should apologise, make a symbolic payment to both Miss X and Mr Y and backdate the direct payment to the date of the initial assessment in October 2022. The Council should also take action to improve its service.

This caused frustration, distress and significant impact on his vulnerabilities. We found the Council at fault. The Council agreed to our further recommendations to remedy Mr X’s injustice with an apology, symbolic payment, and to highlight this as a case study to relevant staff.

    Summary: Miss X complained the Council failed to give her its decisions on her homeless application for nearly two years and it did not take any action to help in line with the main housing duty. She also says it refused to provide her with alternative accommodation until the day before she was due to be evicted from her property. We find the Council was at fault for its delays in sending Miss X its decisions on her homeless application and its failure to take proper action in line with the main housing duty. It was also at fault for refusing to provide Miss X alternative accommodation until the day before the eviction. The Council’s faults caused Miss X distress and uncertainty, and she lost the opportunity to bid for social housing. The Council has agreed to our recommendations to apologise to Miss X, pay her £500, make her a direct offer of the next available suitable property and implement service improvements.

She said she became homeless because she could not afford to pay for two properties. Miss X said it caused financial strain and distress. We do not find the Council at fault.

    Summary: Miss X complained the Council failed to ensure her son, Y received an education after he stopped attending school in June 2023. The Council failed to consider at the time whether it owed Y a Section 19 duty to put alternative provision in place. It also delayed completing Y’s Education, Health and Care needs assessment by 14 weeks which delayed Miss X’s right of appeal to the SEND tribunal. The Council agreed to apologise to Miss X and make payments to acknowledge the distress and uncertainty caused. It also agreed to carry out service improvements.
