Summary: Mrs X complains the Council failed to provide alternative education after her son, Y, became too ill to attend school. We have concluded our investigation having made a finding of fault. Although we found Y’s absence did not trigger the Council’s section 19 duty to provide alternative education, we found that it failed to review Y’s circumstances when he enrolled at a new school in September 2022. There was a missed opportunity by the Council to review the matter and contribute to any forward planning and further support. The Council has agreed to our recommendations.

Summary: Mrs X complained the Council failed to finalise an Education, Health and Care Plan (EHC Plan) for her daughter, failed to name a placement and failed to provide a suitable education as well as a lack of communication and failure to adhere to the complaint procedure. The Council failed to issue the EHC Plan within the statutory timescale and failed to provide suitable alternative education. We also found fault in respect of the complaint procedure. A suitable remedy is agreed.

Statement Not upheld Disabled facilities grants 02-Jul-2024
Summary: Mr X complains about how the Council handled an application for a Disabled Facilities Grant (DGF) for home adaptations for his son, Y. We have concluded our investigation having not made a finding of fault. The evidence demonstrates the Council followed the correct process when assessing Mr X’s application for a DFG. An Occupational Therapist visited Mr X’s home to conduct an assessment on two occasions and reached a professional judgment regarding the adaptations required which were completed. It is not for our service to intervene to offer a different view, nor can we criticise decisions made properly.

Summary: Ms X complained about the length of time the Council took to make and fit a replacement external door at her home. We found fault because the Council did not submit measurements it took for the door which then led to avoidable delays in the new door being made and fitted. Ms X suffered avoidable distress and frustration. To remedy the injustice caused by this fault, the Council has agreed to apologise, make a payment to Ms X and issue reminders to officers.

Summary: Mrs X complained about the Council’s decision to charge her mother, Mrs Y, for her care and support, after first saying there would be nothing to pay. We did not find the Council said Mrs Y would not have to pay for her care and support. However, we found the Council was at fault for not providing clear charging information in writing at the start, and for significant delays completing a financial assessment. But we found no fault in the way the Council completed Mrs Y’s financial assessment.
