It is unlikely investigation would lead to a different outcome. There is not enough evidence of fault in how Care Provider applied the residence contract terms to warrant an investigation. We do not investigate providers’ complaint-handling where we are not investigating the matters which gave rise to the complaint.

Summary: Mr X complained about the Council’s handling of his reports of vehicles parked across a dropped kerb next to the disabled parking bay at his address. Mr X says the vehicles blocked his access to the street and prevented him from using his car. Mr X also complained about the Council’s handling of his complaints. We found fault by the Council. The Council has agreed to provide an apology and financial remedy to Mr X, provide training to its staff and to review its Member’s Enquiry policy.

Summary: Ms X complained the Council failed to ensure her son, Y received an education and the specialist provision in line with his Education, Health and Care (EHC) Plan between September 2022 and May 2024 after he was excluded from school. The Council was at fault which caused Y to miss out on a significant amount of education and specialist provision during this period. The Council agreed to pay Ms X £8,500 to acknowledge Y’s loss of education and the distress and uncertainty caused.
