  • Uttlesford District Council (24 003 273)

Statement Closed after initial enquiries Licensing 14-Jul-2024

Summary: We will not investigate this complaint about the Council’s handling of licensing standards at a kennel and cattery in Ms X’s area. This is because past events fall outside our jurisdiction due to the passage of time and there is insufficient evidence of fault by the Council or injustice caused to Ms X to warrant an investigation into more recent events.

  • Wiltshire Council (24 003 519)

Statement Closed after initial enquiries Enforcement 14-Jul-2024

Summary: We will not investigate this complaint about planning enforcement as there is a right of appeal to a Planning Inspector and the injustice is not sufficient to warrant investigation.

  • Somerset Council (23 016 780)

Statement Upheld Special educational needs 14-Jul-2024

Summary: Ms X complained the Council failed to review her child’s Education, Health and Care Plan in the statutory timescales. Ms X also complained the Council failed to provide education for her child since December 2022. We found fault with the Council delaying review of the Education, Health and Care Plan by six months outside the statutory timescales. We also found fault with the Council failing to ensure Ms X’s child received a suitable education, or the educational provision in their EHC plan, from 15 March 2023 to 5 July 2023 and from 28 September 2023 to 19 January 2024. The Council agreed to apologise to Ms X and pay her £350 for the frustration and inconvenience caused. The Council also agreed to provide Ms X with a payment for any provision she funded from April 2023 to 5 July 2023 and provide her with a payment of £3,250 for her child’s missed education.

  • London Borough of Croydon (23 016 811)

    Statement Upheld Charging 14-Jul-2024

Summary: There was delay by the Council in telling a family of the cost of care for Mr X in his home. The family were made aware there would be a financial contribution towards the care costs and had previously decided they did not wish to arrange care through the Council because of this. The Council has already offered a remedy of an apology, an offer to carry out a financial reassessment and an offer of a payment plan so no further action will be taken as the injustice has been remedied before the complaint was made to the Ombudsman.

Ms X also complained about the delay in finalising the amended EHC Plan. We have found fault causing injustice. The Council has accepted the recommended ways to resolve this.

This caused Ms X financial and emotional distress. The Council is at fault for failing to communicate effectively with Ms X and delay in returning the terminated property.

  • Wirral Metropolitan Borough Council (23 015 874)

Statement Upheld Assessment and care plan 14-Jul-2024

Summary: There is evidence of some fault by the Council in this complaint. There was a delay in allocating a social worker to Mrs Y and a failure to chase up a mental health referral after she went into emergency respite care. This left a level of uncertainty about the impact such intervention may have had on Mrs Y’s care.
