Summary: Ms X complained the Council failed to provide her son with alternative provision and the specialist provision set out in his Education Health and Care Plan when they moved to its area. She also complained it took too long to issue her son’s final Education Health and Care Plan and communicated poorly with her. We found fault by the Council on all matters. The Council agreed to apologise to Ms X and make her symbolic payment to acknowledge Y’s lost provision and the frustration and uncertainty caused to her.

Summary: There was fault by the Council in its handling of this homelessness case. It did not review whether the complainant was in priority need when it should, and required him to provide evidence he was homeless beyond what was legally required, and despite the fact it had already accepted he was homeless. This meant the complainant remained homeless for a period when the Council should have accommodated him. The Council has agreed to offer the complainant a financial remedy, and issue guidance to staff to ensure they correctly understand the law. The Council was also at fault because it gave the complainant inaccurate information about its deposit scheme, but this did not cause an injustice.

Summary: Miss X complained the Council delayed taking action between August 2023 and November 2024 to displace her as the nearest relative under the Mental Health Act for her mother, Mrs Z after she told the Council she was incapable of acting. There are no records showing Miss X asked the Council to displace her prior to November 2024. The Council acted without fault once it was alerted to Miss X’s request and the Court displaced Miss X in February 2025

Summary: Mr Y complained about the Council’s handling of his partner, Ms X’s, council tax account. We found fault because the Council failed to adequately consider in a timely manner whether documents were being served to Ms X at the proper address. This caused Ms X avoidable distress and meant she paid an enforcement fee she should not have been charged. To remedy the injustice caused, the Council has agreed to apologise, refund the relevant fee and issue a reminder to relevant staff.

Summary: Mr B complained that the Council had acted unfairly in respect of the provision of burial plots for his parents following the death of his mother, resulting in significant extra costs on the day of the burial. This caused Mr B significant distress at a very difficult time. We have not found fault with the actions of the Council.
