Summary: Mrs X complains the Council was at fault in the way it dealt with her application for a disabled facilities grant causing distress. We found fault because the Council delayed carrying out an assessment by an occupational therapist on Mrs X for her application. The Council has accepted it was at fault and already apologised to Mrs X for the delay which is suitable action for it to take. There is no evidence of fault by the Council in the way it has assessed Mrs X’s needs and drawn up proposals for adaptations at her property. So we have completed our investigation.

Summary: Mr X complained the Council did not properly explain what he would have to pay for care he received following discharge from hospital. We found there were some missed opportunities and the Council made errors when initially completing the financial assessment. We recommended an apology and a modest payment to Mr X to reflect the impact these issues had. We found overall Mr X was advised there would be care charges and the care costs were payable.

Summary: Mr X complained the Council placed him in an incorrect priority band for his housing register application and did not respond to his calls and emails. He says the Council’s actions negatively impacted his mental health and meant he was homeless for longer than necessary. We found fault by the Council. The Council has agreed to apologise to Mr X, review its decision regarding Mr X’s priority status, and carry out service improvements to avoid the fault re-occurring.

Summary: Miss X complained the Council did not deliver appropriate education to her son after his exclusion from college and that its communication was poor. We found fault because the Council failed to adequately consider its statutory duties, consult with other providers in a timely manner or communicate with Miss X appropriately. Miss X suffered avoidable frustration and distress and her son missed out on some of the education he should have received. To remedy the injustice caused by this fault, the Council has agreed to apologise, make a payment to Miss X, issue reminders and guidance to relevant staff and consider reviewing some of its policies and procedures.

Summary: There was fault by the Council as it delayed issuing an amended Education, Health and Care Plan after an annual review. This delayed the right to appeal to the SEND tribunal and a payment remedies the injustice caused. There was also failure to chase a response from social care during the needs assessment process. There was no fault in the Council’s decision not to provide alternative educational provision as it decided the place at school was suitable and accessible to the child.

Summary: Ms X complained that the Council failed to properly consider her request for adaptations to be made to her council property. We cannot investigate the Council’s actions as a registered social landlord. However, we found the Council was at fault for not considering a Disabled Facilities Grant (DFG). We recommended it apologised, supported Ms X to make a DFG application and then considered the application. We also recommended it corrected its policy.

The Council was at fault for not considering Mrs B’s complaint. The Council will apologise to Mrs B and consider her complaint through the children’s statutory complaint procedure.
