We asked the Council to take steps to remedy the injustice and it agreed to apologise and make a symbolic payment.

We found avoidable delay by the Council in completing the assessment and issuing an Education, Health and Care Plan for Miss X’s child. The Council agreed to apologise to Miss X and make a symbolic payment of £800 in recognition of the distress and impact on C’s preschool education caused by its avoidable delay.

We found fault because the Council failed to consider the complaint under the children’s statutory complaints procedure. This caused Mrs X avoidable distress and frustration. To remedy the injustice caused, the Council has agreed to consider Mrs X’s concerns through the statutory procedure and apologise for failing to do this originally. It has also agreed to make a payment to her and issue guidance to staff.
