Summary: Miss X complained the Council wrongly took recovery action against her for unpaid council tax. Miss X said the Council also wrongly continued its action after she provided evidence her rent payments included council tax. Miss X also said she paid money to the enforcement agents and paid the Council under a payment arrangement for a debt she did not believe she owed. The Council was not at fault for its actions to recover council tax from Miss X. The Council was at fault for delayed responses to Miss X. This caused Miss X uncertainty. The Council has apologised for its delayed communications. This is a satisfactory remedy for the injustice caused.

Summary: The Council was at fault for not issuing the final amended EHC Plan for Mrs X’s child, Y within statutory timescales following an annual review. The Council was also at fault for issuing delayed responses to Mrs X’s complaint. The Council has agreed to apologise and make a symbolic payment to remedy the distress, frustration and uncertainty caused to Mrs X.

Summary: Miss X complained the Council is charging her council tax when she should have full Council Tax Reduction (CTR). We do not find the Council at fault for charging Miss X council tax. However, we find the Council at fault for its poor communication and handling of Miss X’s enquiries. This caused avoidable uncertainty and confusion. The Council has written off Miss X’s council tax bill for the two previous financial years, and this is a satisfactory remedy for most of the injustice caused. It has also agreed to apologise and provide a further explanation of Miss X’s council tax liability.

Summary: There was fault by the Council. It failed to provide care and support to meet Ms X’s eligible unmet needs between August 2024 and January/February 2025. It failed to ensure Ms X’s transition from commissioned services to a direct payment went smoothly. Complaint responses were superficial, did not address all the issues or offer an adequate remedy for the loss of care and support and avoidable distress. Communication was also below our expected standards. The Council also failed to inform Ms X why she could not use a relative as her personal assistant and failed to process invoices meaning there was a further month where Ms X was without essential domestic support. The Council will apologise and make a payment to reflect the avoidable distress and loss of service.

Summary: Mrs X complained on behalf of Mr Y that the Council failed to empty his bins on several occasions. We find the Council at fault, causing frustration for Mr Y. The Council has already apologised to Mr Y, helped him to clear the waste at his property, and made service improvements. We consider this to be a suitable remedy.

Summary: We will not investigate this complaint about the way the Council considered a planning application. The planning permission has not yet been granted therefore we cannot say significant personal injustice has been caused. Also, it is too late to complain about the removal of the site from the green belt as part of the local plan process in 2017.
