    Statement Upheld Special educational needs 31-Jan-2025

    Summary: We uphold Mrs E’s complaint finding there were several flaws in the Council’s oversight of her child’s Education, Health and Care Plan. These meant that for over two years there was no satisfactory review of the Plan which became out of date. We found this caused injustice to Mrs E and her child, including as distress. The Council has accepted these findings and at the end of this statement, we set out the action it has agreed to take to remedy this injustice and improve its service.

    Summary: Mr D complained about how the Council handled his concerns about planning and environmental control breaches by his neighbour since 2021. We found fault by the Council for causing unnecessary delays from Summer 2024. It was not at fault for the delays in taking enforcement action prior to this. The Council should apologise and make payment to Mr D to acknowledge the distress and uncertainty its delays are causing him.

    Summary: Mrs X complained about the care provided to her mother, Mrs Y, by a Council-funded care home. These concerns were investigated by the Council during two safeguarding enquiries. We found the Council took too long to complete the first enquiry, leaving Mrs Y exposed to risk for longer than necessary. Many of Mrs X’s concerns were substantiated by both enquiries, and so we found fault with the Council for delivering poor care. We also criticised the Council’s complaint handling. We made recommendations to address the faults we found.

    Summary: Ms A complained about the way the Council dealt with her child in need matter. She said the Council has caused undue distress and harm to her child. We found the Council at fault and recommended the Council make a payment to Ms A in recognition of any injustice caused.

    Summary: Miss X complained the Council failed to meet statutory timescales for reviewing her daughter, Y’s Education Health and Care Plan. We found the Council took too long to amend Y’s Plan. The Council agreed to apologise and make a payment in recognition of the uncertainty, distress and frustration caused to Miss X.

    Summary: We will not investigate this complaint about the Council issuing an abatement notice to the complainant due to her allegedly causing a noise nuisance. This is because the complainant could reasonably have exercised her right of appeal to the magistrates court against the notice. We have no legal jurisdiction to investigate complaints in these circumstances.

    Summary: We will not investigate this complaint about the Council taking enforcement action over unpaid council tax, or its alledged failure to carry out a care needs assessment for the complainant. This is because the issues about council tax have been subject to legal proceedings and the Council is not the responsible body for carrying out care needs assessments. We therefore have no jurisdiction to investigate these matters. As to the other parts of the complaint, there is insufficient evidence of fault to justify us investigating.

    Summary: We will not investigate this complaint about the suitability of temporary accommodation because part of the complaint is late without good enough reason to investigate it now. Miss X could reasonably have used her review right to challenge the Council’s decision in August 2024 that her temporary accommodation was suitable. The Council’s delay reaching that decision did not cause significant enough injustice to warrant us investigating now.

    Summary: We will not investigate this complaint about the outcome of the occupational therapy assessment. There is not enough evidence of fault by the Council. Ms X also complains the Council shared her personal data without consent. It is reasonable to expect her to complain to the Information Commissioner on this point.
