The Council was at fault because it failed to decide whether to issue Y with an EHC Plan within the statutory timescales, caused by a delay in obtaining Educational Psychologist advice. The Council has agreed to make a payment to Mr X to acknowledge the distress, frustration and uncertainty this caused him.
