Summary: Mrs B complained about aspects of care received by her mother in the final months of her life when she lived in one of the Care Provider’s care homes. We found some evidence the Care Provider was at fault, in particular around meals served to the complainant’s mother. But we also found the Care Provider had offered suitable apologies and taken measures to avoid a repeat. We completed our investigation therefore, finding there was no unremedied injustice caused to Mrs B.

Summary: There was fault by the Council. It failed to process her homelessness application; it did not properly consider its duties; nor communicate with Miss X clearly and in good time. The Council’s shortcomings caused Miss X distress, frustration and uncertainty. It should apologise to her, make a symbolic payment, and remind staff of the expectations of government guidance.

Summary: Mr X complained that the Council had not arranged an advocate for him when he needed this to take part in an assessment of his care and support needs, and took too long to complete a reassessment and reinstate his support. The Council has acknowledged that it was at fault and that Mr X missed out on support that he would have been entitled to. The Council has made several improvements to its services based on its learning from Mr X’s complaint. It will also apologise to Mr X and make a symbolic payment to him in recognition of the impact on him of the missed services.

Summary: The Council was at fault for failing to provide Mrs X with the funds to commission her child, W’s, education for one term. It was also at fault for failing to include necessary information in W’s Education, Health and Care (EHC) Plan. The faults meant W missed out on education and caused Mrs X avoidable frustration. The Council will apologise, make a symbolic payment and amend its policy on EHC Plan personal budgets.

Summary: We will not investigate this complaint about Transport for London’s actions relating to the escalation of a penalty charge notice. This is because it would have been reasonable for Mr X to appeal against the penalty charge notice to London Tribunals and I have not seen enough evidence of fault by Transport for London or its enforcement agents to warrant further investigation. Mr X alleges the enforcement agents damaged his car and assaulted him but these are more appropriately matters for the police.
