There was fault by the Council which caused injustice to Mr and Mrs X. The Council will take action to remedy the injustice caused.

Summary: Ms X complained about delays by the Council in amending her son, Y’s, Education, Health and Care plan after a review, and delays putting special educational provision in place. The Council was at fault and agreed to increase the remedy payment it previously offered for the provision Y missed and for the distress Y’s family suffered.

Summary: Mrs K complains the Council delayed acting after a Tribunal order. It did not provide her daughter with the contents of her Education, Health and Care Plan and did not provide alternative provision when she could not attend school. The Council has still not met all of the Education Otherwise Than At School provision for her daughter. We uphold the complaint. The Council delayed reviewing the Education, Health and Care Plan, putting educational provision in place, paying invoices and making remedies. This led to avoidable distress for Mrs K and her daughter missing provision. The Council has agreed to our recommendations for remedies and a service improvement.

Summary: The Council was at fault in how it decided what priority Mr X should have for social housing. This caused Mr X avoidable frustration, particularly as the Ombudsman had previously found the Council at fault for the same issue. To remedy Mr X’s injustice, the Council will apologise, make a symbolic payment and carry out a new assessment of his priority. The Council will also review what it needs to do to prevent similar fault in future.

We find the Council at fault for reducing Miss X’s weekly support without considering her care needs. This is fault which caused Miss X distress and uncertainty. The Council has agreed to apologise, make a symbolic payment and complete a reassessment of Miss X’s needs.

Statement Upheld Homelessness 27-Mar-2026
Summary: Ms X complained about the Council’s handling of her homelessness application and safeguarding around domestic violence. She said she experienced distress, uncertainty and risk of further violence as a result. We found fault by the Council for its failure to provide interim accommodation and properly consider risks to Ms X for over two weeks. It was not at fault after this as it made a housing offer with review rights. The Council agreed to apologise and make payment to acknowledge the injustice its faults caused her. It will also complete a service improvement recommendation.

Statement Not upheld School transport 27-Mar-2026
Summary: There was no fault in the Council’s decision to not to consider an appeal, against a refusal of school transport assistance, because it is late. We have therefore completed our investigation.
