Summary: Ms Y complained that professionals failed to understand her mother’s personality and wrongly determined she lacked capacity. Ms Y said this led to a decision to transfer her mother to a nursing home which caused her distress. In addition, she said it led to a hospital and a nursing home placing unnecessary restrictions on her mother. We have not found fault in the way professionals considered Mrs X’s capacity. However, we have found fault in the way a Council considered Mrs X’s best interests before placing her in a nursing home. This caused avoidable distress and we have recommended an apology and a small financial payment.

Summary: The Council delayed reviewing its decision that Ms B did not qualify to join the housing register. We have found fault in the time it took the Council to carry out a review of Ms B’s housing application decision. Because of the delay, Ms B suffered uncertainty. The Council will apologise for the delays, backdate Ms B’s housing award date further, and provide a symbolic payment.

Summary: Mrs B complains the Council did not tell her she would need to inform it if she started receiving a personal independence payment when a Council social worker helped her make an application. The Council accepts it knew about the award and should not have backdated charges. The Council has offered a satisfactory remedy which involves an apology, cancelling the backdated charges, payment to Mrs B and reminder to officers.

Summary: Mrs Y disagrees with the Council’s decision to refuse to provide transport assistance for her son, F, to attend the college named in his Education Health and Care (EHC) Plan. She says F attends the nearest suitable college to his home address, but the Council says there is one closer. We find the Council failed to explain the implications of naming Mrs Y’s preferred college in F’s EHC plan. We also find the Council failed to properly consider whether the other college offered a course at the required level for F. The Council will implement the remedial actions listed at the end of this statement.

Summary: Ms X complained about the suitability of the interim accommodation provided to her by the Council. The Council was not at fault for the accommodation provided. It was at fault for delays in advising Ms X it owed her the relief duty and in reaching a decision on her homelessness but this did not cause a significant injustice.

Summary: Ms B says the Council failed to put in place sufficient support to enable her to return home from respite, delayed making those arrangements, failed to carry out mental capacity assessments properly, misled her family about what it was doing and failed to consider a complaint properly. There is no fault in the way the Council arranged the care provision at home. The Council failed to share important information with Ms B and her family, failed to properly advise her and failed to consider a complaint properly. An apology, payment to Mrs C and a reminder to officers is satisfactory remedy.

Summary: The Council took too long to deal with Mr K’s housing application. It also failed to send him key letters regarding his homelessness application, and took too long to deal with his complaint to it about his housing situation. The Council’s failings caused Mr K prolonged distress, uncertainty and frustration. However, it did not significantly affect his opportunities to be rehoused. The Council has agreed a suitable remedy.

Summary: Miss X complained about the Council’s handling of her homelessness application and the temporary accommodation it put her in. There are parts of the complaint we have not investigated because too much time has passed. We find the Council at fault for not completing repair work to Miss X’s property, which left her with water and sewage problems. The Council has agreed to follow up on the remedies it has offered as they are satisfactory to remedy any injustice caused.

The Council agreed to our recommendations on what it should do to remedy the injustice its actions caused Miss X and her family.
