Summary: Mrs Y complained on behalf of her mother, Mrs X. Mrs Y complained about how the Council dealt with securing a residential care home for Mrs X and how it dealt with her care charges. There were some faults by the Council which caused injustice to Mrs Y. The Council will take action to remedy the injustice caused.

Summary: The Council failed to seek evidence about the domestic abuse Ms X reported in a trauma-informed way. This caused her avoidable distress while she sought homelessness support. The Council also failed to notify her of a key decision in relation to her homelessness, failed to offer her interim accommodation and gave her incomplete advice about her housing options. In recognition of the uncertainty, frustration and distress caused the Council has agreed to apologise, pay Ms X £850 and take action to improve its services.

Summary: the Council agreed to amend Ms P’s son B’s Education, Health and Care (EHC) Plan. It issued a final amended Plan 16 weeks after the annual review meeting. This was 4 weeks late. As B was not attending school, this compounds the injustice caused by the delay. The Council has agreed a symbolic remedy.

Summary: Mrs X complained about how the Council handled her child’s transition from education other than at school to a school setting and its failure to provide her child with the personal budgets contained in her Education, Health and Care Plan. Mrs X also complained about how the Council poorly communicated with her. There were some faults by the Council which caused injustice to Mrs X. The Council will take action to remedy the injustice caused.

Summary: Ms X complained the Council has not reviewed her priority on its housing register. Ms X says she continues to live in overcrowded conditions. We have found the Council at fault as Ms X’s priority has not been reviewed. To remedy the injustice caused the Council agreed to apologise, make a payment to Ms X for the uncertainty caused, re-consider her priority and carry out a service improvement.

Summary: Mrs X complained the Council misled her and wrongly said her child had been offered a place at a school. Mrs X said this meant she and her child had prepared to start at this school but it was in vain. She said it caused unnecessary and avoidable distress, frustration and uncertainty. We find the Council at fault, and this caused injustice. The Council has already apologised. It has also agreed to make a payment to Mrs X to reflect the level of injustice caused.

Summary: Mr Y complains the Council did not properly consider his family’s circumstances when it looked at his appeal for D to receive taxi transport to school. In our view there is procedural fault in how the Council handled D’s school transport application and appeal and it has agreed to implement the actions listed at the end of this statement to remedy the injustice caused by fault.

Summary: There was a year’s delay by the Council in arranging the financial affairs of a person without capacity when family members with power of attorney stood down. This was fault and caused unnecessary concern, time and trouble. The Council will apologise, progress the application for deputyship, keep Ms X informed and ensure expenses are reimbursed when the deputyship is in place. The complaint is upheld.
