    Summary: We upheld a complaint from Mrs E, finding the Council failed to adequately consider her child’s access to education during the 2023-24 academic year. We also found fault in it delaying issuing an Education, Health and Care Plan following a review. We considered the injustice caused by these faults included a loss of provision for the child and distress caused to Mrs E. The Council accepted these findings. It has agreed to apologise to Mrs E and make a symbolic payment to her.

It has agreed to provide Mrs X a financial remedy to acknowledge the delay and avoidable distress caused.

We have found fault in the actions of the Council for delays in the Education, Health and Care Needs Assessment for Y and for failing to provide alternative education. The Council has agreed to issue an apology and pay Ms X a financial payment.

    Summary: We will not investigate this complaint about the actions of a Council officer and the decision to issue an Improvement Notice. We will not consider the complaint about the issuing of the Improvement Notice as we have previously considered this. We cannot require the Council to discipline the officer so we cannot achieve the outcome the complainant is seeking. We cannot decide whether the Council is liable to pay the complainant compensation or damages. Finally, it is not a good use of public funds to investigate concerns about the complaint process when we are not investigating the substantive issues.

    Summary: Mrs Y complains about the Council’s decision to implement Child Protection plans for two of her children last year. She says the Council based its decision on false information and malicious allegations and professionals breached her data. The Council upheld some parts of Mrs Y’s complaint due to administrative errors. There is no evidence of procedural fault by the Council which calls into question the decisions it made.

    Summary: Ms B complained the Council recorded inaccurate information about her late brother, Mr C, when he was assessed under the Mental Health Act. Ms B also complained the Council shared this incorrect information with her, meaning she was not aware of the reasons he was admitted to hospital. Ms B said this caused her and Mr C’s family great distress and meant Mr C did not get the care and treatment he needed. We will not investigate Ms B’s complaint about the Council because it is unlikely we could add to the response she has already received from the Council.

    Summary: We will not investigate this complaint about how the Council decided a licensing application for the sale of alcohol. This is because the complainant objected to the application having made relevant representations during this process, and therefore has a right of appeal to the magistrates’ court. We consider the complainant could reasonably exercise that appeal right if he disagrees with the Council’s decision. We therefore have no jurisdiction to investigate.
