    Summary: Ms X complained on behalf of Ms Y about delays issuing and reviewing Ms Y’s Education, Health and Care Plan. She also complained the Council did not put in place special educational provision for Ms Y. We have found the Council at fault for failing to put in place adequate provision for Ms Y and for delaying issuing an Education, Health and Care Plan following an annual review. The Council agreed to apologise, make payments for loss of education to Ms Y and distress caused to Ms X.

    Summary: The Council properly assessed Y following an investigation under the children’s statutory complaints procedure. But it failed to properly explain the outcome of its assessment causing Mrs X uncertainty and distress. It also delayed issuing its stage two response to Mrs X causing further uncertainty. The Council was under no duty to provide Mrs X with direct payments as it assessed Y as having no unmet needs. The Council has agreed to apologise to Mrs X, make a payment to her and rewrite its assessment of Y. It will also develop an action plan to address the failings in how it wrote Y’s assessment.

    Summary: Miss X complained the Council did not provide her child, Y, with the provisions contained in her Education, Health and Care Plan. Miss X also complained the Council did not review Y’s Plan and that it poorly communicated with her. The Council was at fault which caused injustice to Y and Miss X. The Council will take action to remedy the injustice caused.

    Summary: Miss B complained that the Council kept closing her housing applications. We found that the Council failed to clearly communicate the consequences of not providing supporting documents with her initial housing application, which led to its closure. The Council then closed the next two applications Miss B made, without properly explaining why it had done so. This caused Miss B avoidable frustration and inconvenience and delayed her ability to join the housing register. The Council has agreed to assesses Miss B’s application, and if she qualifies, it backdates her award date. The Council will also apologise, make a symbolic payment to Miss B and make service improvements.

    Summary: Mr B complained the Council refused to provide free home to school transport for his child, which he said was contrary to its policy. We found fault in how the Council described its policy, which did not explain how it measured home to school distance in all cases. It agreed to our recommendation to amend this. However, we did not consider this fault caused Mr B injustice. This is because he knew before choosing his child’s secondary school, which school the Council considered the nearest qualifying school for home to school transport purposes.

    Summary: We will not investigate Miss X’s complaint about the Council not authorising a school place offered to her daughter, or naming that school in her daughter’s Education, Health and Care Plan. This is because she has already used her right of appeal at Tribunal.
