    Summary: We upheld Mrs X’s complaint about a delay in transferring her child Y’s Education, Health and Care Plan when they moved into Shropshire. The delay meant Y did not receive the educational provision in his Education, Health and Care Plan between February and July 2025 which was an important year for him. Mrs X and Y are an armed forces family and the gap in Y’s education made the move and settling into the area more difficult and stressful. Communication was also not in line with our expected standards which caused Mrs X avoidable frustration.

    Summary: Ms D complains the Council damaged her possessions when moving them. It had made her sign a waiver under duress. It offered her a payment for the damage, but it did not accept liability. Our decision is the offer of payment is a suitable way of resolving the complaint and, so, does not leave enough personal injustice to warrant further investigation. But we find fault with the wording of the Council’s “removal and pre-storage disclaimer. The Council has agreed to amend the wording of that document.

    Summary: The Council failed to investigate and provide oversight when Mrs X complained that her child, Y’s specialist provision in their Education, Health and Care (EHC) Plan was not being delivered. The Council also delayed consulting with post-16 placements and delayed issuing Y’s post-16 EHC Plan by four months. The Council agreed to apologise and make a symbolic payment to recognise the injustice this caused. It will also take action to prevent similar fault occurring in the future.

    Summary: Ms X complained the Council failed to properly assess her care and support needs and delayed communicating the outcome of its March 2025 Care Act assessment. There is fault in the Council’s delay and consideration of Ms X’s fluctuating needs during the March 2025 assessment. This caused distress, uncertainty, time and trouble and a loss of opportunity to have her needs properly considered sooner. The Council agreed actions to remedy the injustice caused.

    Summary: Miss X complained about delays and the Council’s actions, communication, and handling of special educational provision for her child within their Education, Health and Care Plan. We found the Council acted within expected timeframes with the review process to add the provision. The Council accepted fault with its communication and complaint handling and offered a symbolic payment remedy. We considered this appropriate to reflect Miss X’s injustice and did not make further recommendations.

    Summary: There was fault by the Council. The Council accepted in its official complaint response that it delayed carrying out an annual review of an Education, Health and Care Plan. It also delayed making a Direct Payment so Mrs X could organise the tuition and provision stated in Education, Health and Care Plan. The Council offered a financial remedy during its complaints process, but an increased symbolic payment remedies the injustice to the family.

    Summary: Ms X complained the Council took more than 11 months to assess her needs for adult social care support. We find the Council at fault for part of the delay which caused distress and uncertainty. The Council agreed to apologise and make a symbolic payment to remedy the injustice.
