  • Surrey County Council (25 012 892)

Statement Upheld Special educational needs 16-Aug-2026

Summary: We have found the Council at fault for not considering its Section 19 duty when Mrs X’s child, Y was unable to attend school. Y missed nearly a year of provision at a key point in their education. The Council has agreed to apologise, make Mrs X a symbolic payment and to carry out service improvements.

  • Luton Borough Council (25 012 903)

Statement Upheld Special educational needs 16-Aug-2026

Summary: We find the Council at fault because it did not respond quickly enough to the complainant’s request for alternative education once her daughter (Y) stopped attending the school named in Y’s Education, Health and Care (EHC) Plan. The Council also wrongly changed the arrangement set out in the EHC Plan for Y’s physiotherapy and hydrotherapy (the therapies). The Council has agreed the recommended ways to remedy the avoidable distress and loss of education for Y. We are therefore closing the complaint.

  • London Borough of Brent (25 015 768)

Statement Not upheld Special educational needs 16-Aug-2026

Summary: We have discontinued our investigation into this complaint, about the implementation of specialist educational provision, and other related matters. This is because the complaint is late, and because it would be disproportionate to investigate further, given the extensive investigation already undertaken by the Council.

  • Park View Care Home (Ipswich) Limited (25 016 423)

Statement Not upheld Residential care 16-Aug-2026

Summary: Based on the evidence seen so far, we propose to end our investigation into Mrs X's complaint about the care her mother received. While there is evidence of fault in the care provider's assessment, care planning and monitoring, the provider has already offered a remedy which appropriately addresses the injustice caused. Further investigation is unlikely to achieve a more meaningful outcome.

  • Medway Council (25 016 473)

Statement Upheld Special educational needs 16-Aug-2026

Summary: The Council delayed holding an annual review of Mrs X’s child Y’s Education, Health and Care (EHC Plan for 14 months. It meant Y went without an updated EHC Plan for 15 months. The Council agreed to apologise and make a payment to Mrs X for the injustice this caused. It also agreed to carry out service improvements.

  • London Borough of Brent (25 017 591)

    Statement Upheld Homelessness 16-Aug-2026

Summary: There was fault by the Council. It cannot show that it assessed the suitability of temporary accommodation before it moved Miss X and her children there; it later found that the accommodation was not suitable but did not move her from it; it did not do enough in good time to secure settled accommodation, and it did not recognise it had a duty to protect her belongings. The Council’s shortcomings meant Miss X stayed in unsuitable accommodation for six months and her disabled child could not get to school. She was caused distress and uncertainty. The Council acknowledged some fault and made a symbolic payment. It should make a further payment in recognition of the additional injustice I have found, and take steps to make sure the faults do not recur.

  • Sefton Metropolitan Borough Council (25 017 928)

Statement Not upheld Special educational needs 16-Aug-2026

Summary: We have ended this investigation. Mrs X complained the Council had not issued her child, Y’s, Education, Health and Care (EHC) Plan. The Council has now issued Y’s final EHC Plan and has already put an implementation plan in place. There was nothing worthwhile we could achieve by investigating further.

  • Bristol City Council (25 019 439)

Statement Upheld Special educational needs 16-Aug-2026

Summary: Mr X and Mrs Z complained the Council failed to complete the Education, Health and Care (EHC) assessment process and issue their son’s final EHC Plan within statutory timescales. They also complained about the Council’s communication and complaint-handling. The Council was at fault. There were delays in its EHC assessment process and in the issuing of the final EHC Plan. The Council’s communication was also poor, and its response to Mr X and Mrs Z’s stage two complaint was delayed. Because of this, they suffered distress, frustration and a delayed right of appeal. Their son also missed provisions and support. The Council will make symbolic payments and send us evidence of actions it will take to improve delays.

  • London Borough of Waltham Forest (25 020 126)

Statement Closed after initial enquiries Homelessness 16-Aug-2026

Summary: We will not investigate this complaint about the Council’s assessment of a homelessness application. Delay in issuing a homelessness Relief duty letter for four weeks did not cause any significant injustice to Mr X.

  • Birmingham City Council (25 020 186)

Statement Closed after initial enquiries Homelessness 16-Aug-2026

Summary: We will not investigate this complaint about the Council’s provision of temporary accommodation which Miss X says is unsuitable due to a mouse infestation. It was reasonable for Miss X to seek a review of suitability and use the appeals procedure available under the homeless legislation if this was unsuccessful.
