The Council provided no OT for a year and then failed to provide the OT in line with the provision in the EHC Plan. This had a detrimental impact on her child’s development and caused stress. The Council will apologise and make payments for the lost provision.

Summary: We have found fault with the Council for delays during the annual review of Mrs X’s son’s (Y’s) Education, Health and Care Plan, failing to properly consider its section 19 duty and poor communication with Mrs X and Y’s school. The fault resulted in the delay of Mrs X’s appeal rights, caused Y to miss education and caused avoidable distress for the family. The Council has agreed to apologise and pay Mrs X a symbolic payment in recognition of the injustice caused.

Summary: Mr C complained on behalf of a resident’s association about how the Council dealt with a planning application for works to a wall and balustrades. He said this result in the loss of several mature trees and impact residential amenity and the local environment. We found no fault in the way the Council considered the planning application and the objections it received. It therefore reached a decision it was entitled to make.

Summary: Miss X, on behalf of her mother Mrs Y, complained the Council failed to provide suitable alternative accommodation following a suitability review in July 2024. Mrs Y and her family have been in unsuitable accommodation longer than they should have because the Council has failed to offer alternative accommodation. A symbolic payment to recognise the distress caused is agreed.
