Summary: The Council was at fault for failing to secure the full special educational provision in Mrs X’s daughter, Y’s, Education, Health and Care (EHC) Plan. It was also at fault for delay in completing a review of Y’s EHC Plan. The faults caused Mrs X upset, frustration and uncertainty and meant Y missed out on some provision. To remedy their injustice, the Council will apologise to Mrs X and Y and pay Mrs X a total of £1000.

We have ended this investigation because Y submitted a retrospective planning application and it was unlikely to result in a finding of fault, a remedy for Mr X or any other meaningful outcome.

Summary: The Council was at fault in how it decided whether to arrange alternative education provision for Mrs X’s child, W. This caused Mrs X frustration, uncertainty and frustration and meant W missed out on two terms of provision. To remedy their injustice, the Council will pay Mrs X a total of £1350 and apologise to her. It will also issue a reminder and clarification to staff so the fault does not happen again.

Summary: Ms X complained on behalf of Mr and Mrs Y. Mr and Mrs Y complained the Council failed to provide their grandson, Z, with a suitable education since September 2023. They also complained the Council failed to reassess Z’s need and issue an appealable decision. Mr and Mrs Y also complained the Council failed to ensure Z received the provision in his Education, Health and Care (EHC) Plan. They also complained about issues with how the school handled Z’s behaviours. Mr and Mrs Y said this distressed Z and his family, and he missed out on education and EHC Plan provision. There was fault in the way the Council delayed completing the reassessment of Z’s needs, did not ensure Z received education and plan provision and complaint handling was poor. This frustrated and distressed Mr and Mrs Y and Z missed education and plan provision. The Council has agreed to apologise, make a financial payment and issue guidance to its staff.

Summary: Mrs X complains the Council failed to support her late father, Mr Y, properly after he left hospital in July 2024. Both the council and the care provider were at fault for failing to recognise the need for an urgent review of Mr Y’s needs. This caused avoidable distress to Mrs X and delayed funding for Mr Y’s care home placement. The Council has agreed to apologise and make a symbolic payment to Mrs X. It will also reassess the charges for Mr Y’s care and take action to improve working practices.
