Summary: Mrs B complained about the Council’s handling of her son’s (X) education. The Council apologised for its poor handling of her enquiry about a personal budget, and it agreed it caused delays in the annual review process for his Education, Health, and Care plan. This was fault which caused Mrs B distress and uncertainty. However, we cannot say X experienced an injustice as a result. The Council will make a symbolic payment to acknowledge the impact its faults had on Mrs B. There was no fault on how the Council considered its alternative provision duty, and other parts of the complaint were not investigated as these were late or carried appeal rights.

Summary: Mrs X complained about delays in carrying out a Child in Need assessment for her child, Y and about non-delivery of social care support. The Council was at fault for failing to consider Ms X’s complaint through the children’s statutory complaint procedure. The Council agreed to apologise and make a symbolic payment to Mrs X to acknowledge the distress and frustration this caused. It will now consider Mrs X’s complaint by starting a stage two investigation through the statutory procedure.

Summary: Mr F complained the Council failed to meet his care and support needs and wrongly charged him for his care. I found no fault in the way the Council decided how to meet Mr F’s needs or in its calculations of his contributions. The Council failed to carry out a carer’s assessment of Mr F’s carer, Mr J. This was fault which causes Mr J uncertainty about whether other support could have been offered. The Council has agreed to offer a carers assessment to Mr J and pay him £300 to remedy the injustice.

Summary: The Council was not at fault for the way it reached the decision to stop funding Mr Y’s speech and language therapy. It was at fault for failing to consider whether to increase Mr Y’s direct payments annually. It has already paid a backdated percentage increase which was an appropriate way to resolve this. It was at fault when it failed to pay invoices on time which meant the speech and language therapist cancelled some sessions. The Council has agreed to pay Mr Y the equivalent cost of the missed sessions so that he can privately pay for the missed provision.
