Summary: Miss Y complained the Council failed to deliver the special educational provision in her child, Z’s Education Health and Care Plan and provide them with a suitable education. We have found fault by the Council, causing injustice, in failing to: make sure Z received all the special education provision in their Plan and properly investigate Z’s circumstances when they were struggling to attend school. The Council has agreed to remedy this injustice by apologising to Miss Y, making payments to acknowledge the distress caused and impact on Z, and service improvements.

Statement Upheld Assessment and care plan 11-Dec-2024
Summary: Mrs X complained that the Council failed to take adequate action when she raised concerns about her late mother’s health and living conditions despite having knowledge of her history of mental health problems and hoarding behaviours. We found no grounds to criticise the Council’s actions. However, it was at fault in that it delayed in responding to Mrs X’s complaint. The Council has provided a satisfactory remedy for the injustice caused by this.

Summary: The Housing Ombudsman Service (HOS) found service failure by the Council for delay dealing with Ms X's reports of disrepair in her council tenancy. LGSCO found fault by the Council in its assessment of Ms X's medical needs. Both Ombudsmen found fault with the Council's decision making about Ms X's management transfer and for delays in the complaint process. The Council has agreed to remedy the injustice to Ms X and improve its services.

Summary: Mr B complained that the Council failed to properly consider his medical condition when considering the suitability of his current accommodation. We found the Council delayed in carrying out a review of its decision but we do not consider this caused Mr B an injustice as the decision remained the same.

Summary: We found fault with the Council for not taking responsibility for the complainant’s (Mr X) son’s (Y) education when he was out of school, for the delays with Y’s Education Health and Care needs assessment and issuing Y’s Education Health and Care Plan and when dealing with Mr X’s complaint. The Council’s fault caused injustice to Y and Mr X. The Council agreed to apologise, to make symbolic payments and to carry out training for the special education and disabilities team and the complaint handling staff.

Statement Upheld Homelessness 11-Dec-2024
Summary: The Council was at fault for failing to address ongoing issues of damp and mould and anti-social behaviour in Miss X's temporary accommodation. The Council was also at fault for poor communication, delay acting on actions identified by its complaint process, and failure to keep the suitability of the accommodation under review. As a result, Miss X spent 19 months in unsuitable accommodation. To remedy this injustice, the Council has agreed to apologise, make payments to Miss X, and act to improve its services.

Summary: Mr B says the Council wrongly stopped the person who had managed his direct payment for many years from doing so, failed to explain its decision, moved him to a Council managed budget without consent and refused to allow someone to attend his review. There is no evidence of fault in the Council’s decision to stop the person managing Mr B’s direct payments or in its decision to move him to a managed budget. The Council delayed making those decisions and failed to ask Mr B for his views on who to include in the review meeting. An apology, payment and reminder to officers is satisfactory remedy.
