The Council has agreed to our recommendations for symbolic payments for missed educational provision.

Summary: Ms X complained the Council did not provide her child, Y, with full-time education, speech and language therapy and that it also wrongfully withdrew Y’s speech and language therapy provision. There was fault by the Council which caused injustice to Y and Ms X. The Council will take action to remedy the injustice caused.

Summary: The complaint is about the Council not providing Mrs H’s daughter with education she was entitled to, partly because it was using out of date information in her Education, Health and Care Plan. We uphold the complaint, due to the Council not checking with the school about what alternative provision it was putting in place when the child stopped attending school. The Council has agreed to our recommendation that it make Mrs H a payment for tuition fees she could have avoided. And a symbolic payment for the uncertainty about whether Mrs H’s daughter might have been able to receive more provision but for the fault.

Summary: Mrs X complained the Council failed to provide her son, Y, with the support ordered by the Special Educational Needs and Disabilities (SEND) Tribunal. She also complained the Council disregarded professional advice when reviewing Y’s Education, Health and Care (EHC) Plan. The Council was at fault in delaying implementing some parts of the Tribunal Order. This distressed Mrs X and her family and Y missed provision. The Council has agreed to make a financial payment.

Summary: Ms X complained about the Council’s handling of Mr Y’s care charges and financial assessment. She also complained about the Council’s delay in discharging Mr Y from respite care, and said it failed to explain why he could not go home after the initial six-week reablement period. The Council is at fault for delay in making an occupational therapy referral. It is also at fault for the way it communicated with Ms X about the charges. This caused avoidable uncertainty and distress. The Council has agreed to apologise, make a payment, and make a service improvement.

Summary: Mrs A complained about the hospital discharge process for her mother and the Council’s complaint response. We found fault with how the Council communicated with Mrs A; it did not provide a full explanation of how it made decisions. This caused uncertainty and Mrs A felt she wasn’t listened to. We also found fault with the language used in the Council’s complaint response which led to further uncertainty for Mrs A. The Council agreed to our recommendations to remedy this. We found no fault with the Trust’s actions.
