Manchester City Council (24 011 333)
Statement Closed after initial enquiries Special educational needs 11-Dec-2024
Summary: We cannot investigate how the Council decided on the placement it would name in an Education, Health, and Care Plan. This is because Ms X had a right to appeal this decision and it would have been reasonable to expect her to use this right. Nor will we investigate Ms X’s complaint about delays in issuing the plan, because there is no significant injustice remaining that would justify an investigation.

London Borough of Sutton (24 011 359)
Statement Closed after initial enquiries Special educational needs 11-Dec-2024
Summary: We will not investigate this complaint about alleged delay by the Council in meeting Ms X’s child’s special educational needs. The complaint is late, and there is no good reason to exercise discretion to investigate these matters now. Even if that were not so, Ms X exercised her right to appeal to the Special Educational Needs and Disability Tribunal. The content of the child’s Education Health and Care Plan, and how the Council assessed the child’s needs in deciding that content and the school placement, are matters that we could not investigate.

Wirral Metropolitan Borough Council (24 012 313)
Statement Closed after initial enquiries Charging 11-Dec-2024
Summary: We will not investigate this late complaint about Mrs Y’s care and charges. There is not a good reason for the delay in the matter being brought to the Ombudsman. It is not a good use of public resources to investigate complaint handling in isolation when we are not considering the substantive matter.
-
Leeds City Council (24 012 346)
Statement Closed after initial enquiries Other 11-Dec-2024
Summary: We will not investigate this complaint that the Council did not suspend recovery action while the complainant was appealing to the tribunal about a penalty in relation to landlord licensing. This is because there is insufficient evidence of fault causing injustice.
-
Wakefield City Council (24 012 645)
Statement Closed after initial enquiries Councillor conduct and standards 11-Dec-2024
Summary: We will not investigate this complaint about how the Council dealt with a complaint about the conduct of a parish councillor. This is because we are unlikely to find fault.
-
East Sussex County Council (24 015 981)
Statement Closed after initial enquiries Highway repair and maintenance 11-Dec-2024
Summary: We will not investigate Mr B’s complaint that his car was damaged by a pothole the Council failed to repair. This is because it is reasonable for Mr B to pursue his compensation claim by taking the Council to court.
-
London Borough of Tower Hamlets (24 011 940)
Statement Closed after initial enquiries Allocations 10-Dec-2024
Summary: We will not investigate this complaint about the Council’s assessment of a housing application since 2016. This has been subject to an earlier complaint which was considered and decided in 2024. There is insufficient evidence of fault in the outcome of a recent review which would warrant an investigation.
-
High Peak Borough Council (24 011 965)
Statement Closed after initial enquiries Enforcement 10-Dec-2024
Summary: We will not investigate Mr X’s complaint about the Council deciding not to take enforcement action against a firm which leases a site near his property, allowing the firm to apply for retrospective planning permission, and delay in that application process. There is not enough evidence of fault in the Council’s enforcement process to warrant investigation. Even if we were to investigate, there is insufficient significant injustice stemming from the enforcement decision to justify us investigating. Investigation of the planning application process would not lead to a different outcome. We also cannot achieve the outcomes Mr X wants from his complaint.
-
Guildford Borough Council (24 011 994)
Statement Closed after initial enquiries Antisocial behaviour 10-Dec-2024
Summary: We will not investigate this complaint about the Council’s handling of the Fixed Penalty Notice issued to Ms X for littering. This is because the tests in our Assessment Code are not met and there are insufficient grounds to warrant an investigation.
-
Westminster City Council (24 012 993)
Statement Closed after initial enquiries Other 10-Dec-2024
Summary: We will not investigate this complaint about the operation of private bike hire schemes. This is because there is insufficient evidence of fault by the Council and because there are other bodies who are better placed to consider the issues.
