    Summary: Ms G complained about the care and support provided to her late father, Mr D by the Care Provider. We found fault with the Care Provider’s record keeping and the accuracy of information it recorded in Mr D’s care records. Some of the care Mr D received fell below the standard he should reasonably have expected. The Care Provider has agreed to our recommendation and will write to Ms G and offer to pay her £7,500 as a symbolic payment to acknowledge the overall injustice caused by the faults. The Care Provider previously apologised and acted to improve.

    Summary: Mrs X complains there were failings in the way the Council ensured her child Y received the educational provision set out in their Education Health and Care Plan (EHC Plan) following an EHC needs assessment and when they were out of school causing distress and loss of educational provision. We will not investigate Mrs X’s concerns about the EHC needs assessment in 2022 to 2023 because the complaints are late. We will not investigate Mrs X’s complaints about the EHC Plan and the school setting for Y as Mrs X has the right of appeal against the decision. So, we have ended our investigation.

    Summary: Miss G complains about the Council’s actions after she was the victim of fraud. She says the Council should have allowed her to stay in a property as interim accommodation, as the landlords were happy with that arrangement. But the Council tried to move her to interim accommodation further away from her children’s schools and only gave her short notice. We do not uphold this complaint, as the Council was entitled to make the decisions it did. So they are not ones the Ombudsman can criticise.

    Summary: Mrs B says the Council delayed making a decision following a review of her son’s education, health and care plan, issued the wrong decision and failed to put in place education for her son. The Council delayed issuing a decision following the review and then issued the wrong decision but there is no fault in the failure to put in place education for Mrs B’s son for the period before the appeal right arose. An apology, payment to Mrs B and a reminder to officers is satisfactory remedy.

    Summary: Mrs X complained about the Council’s handling of its investigations into her neighbour’s behaviour causing an infestation of rats. We did not find fault with the Council’s general progression of enforcement. We found fault with some initial delays, record keeping and the Council not evidencing a risk assessment of Mrs X and her family with the behaviour reported. The Council has agreed to our recommendations to remedy the injustice caused.

    Summary: Mrs H complains the Council allowed her application for a disability band reduction on her council tax, but later said it had made an error and she did not qualify for a reduction. But she had reasons why the Council’s decision was wrong. Our decision is there was fault in how the Council carried out the first assessment. The Council has agreed to our recommendations.

    Summary: The Council’s failure to decide whether it owed Mr X a homelessness duty in 2022 was fault. It failed to recognise that he was homeless because of domestic abuse and failed to provide interim accommodation. The Council has agreed to apologise, backdate Mr X’s housing application, make a payment and act to improve its services.

    Summary: Ms X complained that the Council failed to ensure her son, C, received the special educational needs provision set out in his education, health and care plan and unreasonably threatened to restrict her contact with officers. We found C did not receive all the one-to-one support set out in his plan. In recognition of the injustice caused, the Council has agreed to apologise to Ms X and make a payment to her.

    Summary: Mrs X complained the Council failed to provide her child with alternative education provision despite being aware he could not attend school full-time and delayed issuing a final Education, Health and Care plan following an emergency review. Mrs X says her son did not receive suitable full-time education and missed provision set out in his final plan. We found fault by the Council but consider the agreed action of an apology, provision of any missed speech and language therapy and a symbolic payment provides a suitable remedy.

    Summary: Mrs X complained that bailiffs repeatedly contacted her about penalty charge notices she believes were revoked, and contacted her during a period of ‘breathing space’. Mrs X also complained about the Traffic Enforcement Centre’s appeal process. Mrs X said this had an impact on her mental health and wellbeing. We do not find the Council at fault. Also, we cannot investigate the Traffic Enforcement Centre as it is outside our jurisdiction.
