Summary: Mr X complained about the Council’s failure with annual reviews for his grandchild’s Education, Health and Care Plan and not updating it with specialist provision they needed. We found the Council at fault. This has caused significant injustice to Mr X’s grandchild as they missed out on specialist provision they were entitled to. The Council has agreed to apologise and make a symbolic payment to remedy the injustice caused.

Summary: There is no fault in the Council’s financial assessment for Ms Y’s care charge. The Council considered evidence from Mrs X including a lodger’s agreement and explained it was not satisfied Ms Y was liable for rent or that she paid housing costs. It has included revised disability related expenditure allowances in line with guidance. So we do not uphold the complaint.

Summary: Mr X complained about the advice provided to him by the Council about maintenance work being carried out at his property. He says the Council misinformed him which directly led to the work being delayed. There was then further delay from the Council while it considered his application. During this time, he says that he could not live at the property. We found the Council at fault, and this caused avoidable distress. It will apologise and make payment to Mr X.

Summary: Mrs X complained on behalf of Miss Y that the Council failed in its responsibilities towards Miss Y. The Council was at fault for failing to make findings at stage three on all complaint points, delaying in completing the statutory complaints process and delaying in completing all of the recommendations. This caused Mrs X and Miss Y distress, frustration and uncertainty. The Council will apologise, make payments and provide an action plan to complete recommendations.

Summary: Mr X complained the Council failed to contact him when carers from Comfort Care Services failed to gain access to his mother’s property to deliver care services on three subsequent days. The care provider failed to follow its no reply procedure and Mr X’s mother was found by paramedics in a distressing state which required hospital admission. A remedy to acknowledge the distress and improve services to prevent similar situations is proposed.

Summary: The Council’s different departments failed to work collaboratively to plan for Ms Y’s transition to adult care services from an Education, Health and Care (EHC) Plan. The Council failed to consider an interim review of Ms Y’s EHC Plan and to ensure it met her eligible care needs. It also failed to properly respond to Ms Y’s parents’ (Mr and Mrs X) complaint. This caused Ms Y distress and uncertainty and Mr and Mrs X time and trouble pursuing the matter. The Council has agreed to apologise, make a payment to Ms Y and Mr and Mrs X, and carry out a review that considers both Ms Y’s education and social care needs.

Summary: Ms X complains the Council has not dealt properly with services for her family including reviewing an Education Health and Care Plan, her son’s education provision, blue badge applications, a carers assessment and has not handled her complaints properly. The Council is at fault because it delayed an Education Health and Care Plan annual review, failed to make special educational provision, closed a child in need plan without informing her and did not deal with part of her complaint through the correct complaints process. Ms X suffered a delayed right of appeal and Y missed special educational needs provision. The Council should apologise, make a symbolic payment to Ms X, repay Ms X costs of therapy provision and make service improvements.

Summary: X complained about the Council’s actions where it repeatedly, over the years, mowed down an area of growing bee orchids. We found the Council at fault with its actions which caused significant frustration to X. The Council agreed to send us evidence of its investigations into the matter and an action plan to prevent future recurrence of this fault.
