  • Bristol City Council (20 012 152)

    Statement Not upheld Other 29-Sep-2021

Summary: Mr F objects to a nursery’s charge of £1 per hour for “consumables” when his children access their free early education entitlement. It is for the nursery to decide how to respond to parents who cannot or do not want to pay the charge; Mr F could take his business elsewhere. The Council is working with the nursery to ensure its charges are clear, transparent and itemised. There is no fault by the Council.

  • Southend-on-Sea City Council (21 005 915)

Statement Closed after initial enquiries Other 19-Sep-2021

Summary: We will not investigate Mrs B’s complaint that the Council was at fault in failing to provide her with information. This is because there is not enough evidence of fault to justify investigating.

  • North Yorkshire County Council (21 005 657)

Statement Closed after initial enquiries Other 14-Sep-2021

Summary: We cannot investigate this complaint about the disclosure of information by a school and the Council’s management of Mrs B’s subsequent complaint. This is because the substantive matter relates to the actions of a school.

  • Southampton City Council (21 004 903)

Statement Closed after initial enquiries Other 10-Sep-2021

Summary: We cannot investigate Mrs X’s complaint about events inside a school. The law does not allow us to do so.

  • Essex County Council (21 005 554)

Statement Closed after initial enquiries Other 03-Sep-2021

Summary: We cannot investigate this complaint about how the Council has dealt with a school. This is because the complainant is complaining about matters that happened whilst she was a Governor at the school. She is therefor not complaining as a member of the public.

  • Lincolnshire County Council (20 011 505)

    Statement Upheld Other 27-Aug-2021

Summary: a nursery’s charge of £1 per hour for “consumables” is not a top-up fee, but the charges are not clear. The Council has agreed to work with the nursery to ensure its charges are clear, transparent and itemised, and parents understand how they can access free childcare without paying the charge when the nursery is delivering the Free Early Education Entitlement.

  • London Borough of Hillingdon (21 000 600)

Statement Closed after initial enquiries Other 10-Aug-2021

Summary: We will not investigate this complaint about the Council’s response to complaints of overcharging for nursery care. This is because further investigation would not add anything to the Council’s previous investigation, and we cannot achieve the outcomes the complainant seeks.

  • West Sussex County Council (20 008 912)

Statement Closed after initial enquiries Other 23-Jul-2021

Summary: We will not investigate this complaint about the conduct of a council legal officer in her role as Single Point of Contact (SPOC) for the complainant with his child’s school, and the way in which the Council has handled complaints about the matter. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. The substantive issue is out of our jurisdiction because it relates to someone carrying out a function on behalf of the governors and headteacher of a school. The Council’s actions in response to the complaints about the officer are also out of jurisdiction because they are in connection with something that is itself out of jurisdiction. Additionally allegations about breaches of GDPR should be made to the Information Commissioner’s Office.

  • Stockport Metropolitan Borough Council (21 003 018)

Statement Closed after initial enquiries Other 21-Jul-2021

Summary: We will not investigate this complaint about the Council’s portage service. This is not warranted by the claimed injustice, and we could not add to the investigation already carried out by the Council.

  • Isle of Wight Council (21 001 695)

Statement Closed after initial enquiries Other 19-Jul-2021

Summary: A man complained about the Council’s consultations over the closure of a school. But we do not have grounds to investigate this matter. This is because the Council has now suspended its closure plans, and we are unlikely to achieve a more worthwhile outcome in the circumstances.
