    Summary: Miss X complained the Council delayed completing her son, Y’s Education, Health and Care (EHC) needs assessment in line with statutory timescales. The Council was at fault. It delayed deciding whether to issue Y with an EHC Plan within the statutory timescales, caused by a 15 week delay in obtaining Educational Psychologist (EP) advice. It then further delayed issuing Y’s final EHC Plan by 18 weeks after it received the EP advice and failed to respond to Miss X’s request for mediation. This caused Miss X distress, uncertainty and delayed her right of appeal to the SEND tribunal. It agreed to make payments to acknowledge this injustice.

    Summary: Miss X complained that although she should receive an assisted collection service, the Council has repeatedly failed to collect her household waste and recycling as scheduled, despite collecting her neighbours waste. We find the Council’s repeated failure to make regular assisted household waste and recycling collections, and to return Miss X’s bin correctly is fault. This fault has caused Miss X an injustice.

    Summary: Ms X said the Council was not providing the property protection service Mr Z was paying for and its failure to do so might affect Mr Z’s ability to meet his care costs. We found fault in the Council’s service delivery but it did not cause Mr Z significant personal injustice. We also found fault in the Council’s handling of Ms X’s complaint about its property protection service, which was frustrating for Ms X. To put matters right, the Council agreed to apologise to Ms X and make a symbolic payment of £200.

However, the Council’s communication about this was at times unclear, particularly on whether council tenants can apply for a Disabled Facilities Grant (DFG). There was no fault in how it dealt with Mr B’s request for other minor adaptations.

    Summary: The Council was at fault for not putting in place all the provision listed in a child’s Education, Health and Care Plan following a decision from the Special Educational Needs and Disability Tribunal. To remedy the injustice caused the Council agreed to apologise, make financial payments and put in place the remaining provision.

The Council has agreed to resolve the complaint by offering to make a suitable payment to the complainant to remedy the injustice this cause. We will not investigate the Council’s decision not to issue an EHC Plan because it is reasonable for the complainant to use their right of appeal to a tribunal.
