Summary: The Council failed to consider information Mr B provided to support his housing application which led to it wrongly deciding he did not qualify to join the housing register. The Council then delayed assessing the information after agreeing to fast track his application. As a result, Mr B was unable to bid on the housing register for around 11 months. We have recommended that the Council apologises, makes a payment to Mr B and backdates his application award date. We have also recommended service improvements.

Summary: There was fault by the Council. The Council has not assessed whether the family are statutorily overcrowded or investigated complaints of damp and mould in the privately rented property. Carrying out the assessments, apologising and reassessing the families housing priority remedies the injustice. There is no fault in the Council’s assessment of medical priority.

Summary: Miss B complained that the Council delayed in completing an Education, Health and Care (EHC) needs assessment for her son, C and issuing an EHC Plan. We have found fault in the Council’s actions. It has agreed to apologise to Miss B and pay her £500.

Summary: Mrs X complained the Council did not issue her child’s education, health and care plan by the statutory deadline, and it failed to provide appropriate educational provision for her child. Mrs X said this meant her child lost their place at specialist educational provision, and it caused unnecessary and avoidable distress. We find the Council at fault for the delay issuing the plan and this caused injustice. The Council will make a payment to remedy the injustice. We cannot investigate the second part of the complaint because it is premature.

Mr X says this meant he is living in unsuitable accommodation which impacted his mental health. We find the Council at fault which caused Mr X injustice.
