Farrington Care Homes Limited (22 017 306, report)
Overview:
Summary
The Local Government and Social Care Ombudsman investigated a complaint about the care provided to a resident (Mr Y). Lyme Regis Nursing Home operated by Farrington Care Homes Limited did not: provide adequate personal care to Mr Y; care and manage Mr Y’s wounds and prevent pressure sores; manage Mr Y’s diabetes; keep adequate records. The council’s safeguarding investigation said there were evidential acts of neglect and omissions in Mr Y’s care. This caused Mr Y unnecessary pain and suffering, and his family significant distress.
Recommendations
We recommended Farrington Care Homes Limited:
- Reimburse Mr Y’s estate the seven weeks fees he paid while a resident, and the two-week notice period the home charged.
- Pay Mr Y’s daughter £350 for the distress and uncertainty she was caused.
Farrington Care Homes Limited’s response
It says it has not done what we asked because:
- it says it is unreasonable to pay the refunds given the cost of providing comprehensive care, highly trained staff, specialised medical equipment, essential supplies and facility maintenance.
- agreeing to the refund would negatively impact on its ability to maintain the high standards of care its residents and their families expect and deserve.
Ombudsman's response
We are not satisfied Farrington Care Homes Limited has put right the injustice for Mr Y’s family. The law says we can require Farrington Care Homes Limited to pay for publication of this notice. It has not responded to, or commented on the notice, and refused to publish it. Therefore, we have published this notice and will recover our costs from the provider.
