Summary: The Council was at fault in relation to Miss X’s child, Y’s, Education, Health and Care (EHC) Plan reassessment when it delayed making a decision and did not give her appeal rights to the Tribunal. But this did not cause Miss X a significant injustice in the investigation period. The Council was not at fault when it issued Y’s EHC Plan and gave Miss X her appeal rights in September 2024. It used the process we would expect.

Summary: Miss D complains the Council delayed allowing her to bid for a larger social housing property. I have not found fault overall in the handling of the case except for one instance when the Council failed to clarify how it had assessed some evidence and applied its Allocations Policy. The Council will apologise to Miss D and revise its guidance on this matter for officers.

Summary: Mrs X complained on behalf of her late uncle, Mr Y, that the Council gave incorrect information about the cost of care at home after discharge from hospital. We have found the Council at fault for failing to communicate effectively about the care charges. The Council agreed to waive some charges, to make a symbolic payment to Mrs X in recognition of the avoidable distress and uncertainty. It will also remind staff of the importance of providing clear and transparent information about care arrangements and charging.

Summary: Mr X and his legal representative Mr Z complained the Council wrongly decided Mr X’s mother, Mrs Y, deprived herself of assets for the purpose of reducing her care fees. We find the Council was at fault for failing to evidence it fully considered Mr X’s representations and the documentation he provided. This caused Mr X uncertainty and frustration. The Council has agreed to apologise to Mr X, rehear his stage two appeal with a different panel and implement a service improvement.

Summary: Mr X complained Wolverhampton Homes, on behalf of the Council, took too long to complete works to adapt his kitchen. He also complained it did not provide sufficient temporary facilities during the works, did not keep him updated about the works and installed different kitchen units to those agreed. We found fault by Wolverhampton Homes, on behalf of the Council, on these matters. The Council agreed to apologise to Mr X and make him a payment in recognition of the injustice caused to him and the extra costs he incurred.
