  • Leicester City Council (20 010 069)

    Statement Upheld Pollution 29-Mar-2022

Summary: Mr X complains the Council failed to properly investigate reports he made about noise and breaches of a construction method statement agreed by a contractor for a large development near to his home. We found there was fault by the Council that warrants a remedy to Mr X.

    Statement Upheld Pollution 08-Mar-2022

Summary: Mr B complained that the Council failed to take action in relation to his neighbour’s wood burner which was emitting smoke and fumes at first-floor level affecting his enjoyment of his property and garden. The Ombudsman found the Council properly investigated Mr B’s concerns. It failed to keep Mr B properly informed but this did not cause him a significant injustice.

Statement Closed after initial enquiries Pollution 01-Mar-2022

Summary: We will not investigate this complaint about the Council’s response to Mr X’s reports of noise and toxic fumes coming from a neighbouring property. This is because we are unlikely to find evidence of fault by the Council.

Summary: Mr X complained the Council failed to take action to enforce a planning condition. We have not found fault with the Council.

  • London Borough of Croydon (21 013 674)

Statement Closed after initial enquiries Pollution 27-Jan-2022

Summary: We will not investigate Mr X’s complaint about how the Council responded to reports of noise nuisance as there is not enough evidence of fault to warrant investigation. Mr X also complained about delays in installing noise monitoring equipment. However, the Housing Ombudsman Service has already investigated and remedied this complaint, therefore, there is insufficient evidence of outstanding injustice to warrant further investigation.

  • Wakefield City Council (21 013 270)

  • East Sussex County Council (21 005 817)

  • East Riding of Yorkshire Council (21 002 777)

    Statement Not upheld Pollution 04-Jan-2022

Summary: There is no evidence of fault by the Council. It has investigated Mr X’s complaints about flood lights and as there is no statutory nuisance, has not served an abatement notice. The Council has investigated complaints about development without planning and listed building consent. It has spoken to the neighbour and invited the submission of applications to decide if the developments are acceptable. There is no evidence of fault in the Council’s process.

  • Scarborough Borough Council (21 007 294)

Statement Closed after initial enquiries Pollution 20-Dec-2021

Summary: We will not investigate this complaint about odour from a neighbouring property. This is because there is no evidence of fault in how the Council investigated odours and anti-social behaviour issues. The Council has apologised for writing to Mr X’s neighbour about the issues Mr X raised. This is a suitable remedy and it is unlikely an investigation would result in a different outcome.
