The Ombudsman's final decision:
Summary: We cannot investigate this complaint about a transport company’s refusal to award X with a concessionary travel pass. The transport company is not a body who’s actions we can investigate. Nor can we consider a complaint about the Authority’s role, because the transport company was not performing an administrative function of the Authority.
The complaint
- X complained about the decision a transport company took, to refuse an application for a concessionary travel pass. They said its decision was contrary to relevant legislation. X said because the company was providing services on behalf of the Authority, it was equally liable for this decision.
The Ombudsman’s role and powers
- We cannot investigate complaints about actions which are not the administrative function of an organisation. (Local Government Act 1974, section 26(1) as amended).
