Summary: We cannot investigate this complaint about a moving traffic penalty charge notice as the matter is no longer within our remit since Mrs X appealed against it to the independent tribunal.
The complaint
- Mrs X complains about a penalty charge notice (PCN) the Council issued to her when she turned into a prohibited street. Mrs X is unhappy the Council and London Tribunals did not cancel the PCN despite her having explained the reasons why she took this route. Mrs X feels the Council’s treatment of her is inhumane.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
- We cannot investigate a complaint if someone has appealed to a tribunal about the matter. (Local Government Act 1974, section 26(6), as amended)

My assessment
- As per paragraph three, we cannot investigate because Mrs X appealed against the PCN to London Tribunals and the matter is therefore no longer within our legal remit.
