  • East Hertfordshire District Council (23 011 190)

Statement Closed after initial enquiries Building control 13-Feb-2024

Summary: We will not investigate Mr X’s complaint about a building control matter. This is because there is not enough evidence of fault by the Council or to show its actions caused Mr X significant injustice. We also cannot achieve the outcome Mr X wants.

  • London Borough of Bromley (23 017 010)

Statement Closed after initial enquiries Building control 09-Feb-2024

Summary: We will not investigate this complaint about how the Council dealt with a building control matter. This is because it is unlikely we could achieve a worthwhile outcome for the complainant and he has not suffered any significant injustice.

  • Burnley Borough Council (23 015 232)

Statement Closed after initial enquiries Building control 08-Feb-2024

Summary: We will not investigate this complaint that the Council is delaying in responding to requests for information. This is because the Information Commissioner is the suitable body to consider this matter.

  • Tandridge District Council (22 014 405)

    Statement Upheld Building control 18-Jan-2024

Summary: Mr X complained the Building Control Partnership, acting on behalf of the Council, gave misleading advice and instruction resulting in additional and unnecessary work being completed. We have only found fault with the Council’s record keeping and some of its communications. To remedy the injustice caused to Mr X, the Council has agreed to apologise and make a modest payment. We are unable to make findings on parts of Mr X’s complaint.

  • Birmingham City Council (23 011 452)

Statement Closed after initial enquiries Building control 21-Dec-2023

Summary: We will not investigate this complaint about building work carried out by the complainant’s neighbour. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate.

  • East Devon District Council (23 012 053)

Statement Closed after initial enquiries Building control 30-Nov-2023

Summary: We will not investigate Mrs X’s complaint about the Council’s interpretation of the Building Regulations. This is because we cannot decide whether the Council’s interpretation is correct. If Mrs X believes the Council should not require her to carry out additional work to comply with the Regulations it would be reasonable for her to appeal to the Secretary of State.

  • Central Bedfordshire Council (23 010 705)

Statement Closed after initial enquiries Building control 06-Nov-2023

Summary: We will not investigate Mr X’s complaint that the Council failed to identify issues with his building work and has refused to reimburse him for putting them right. This is because we cannot hold the Council responsible for the issues or achieve any worthwhile outcome for Mr X.

  • Middlesbrough Borough Council (23 011 361)

Statement Closed after initial enquiries Building control 31-Oct-2023

Summary: We will not investigate this complaint about how the Council dealt with a building control matter. This is because it is unlikely we could achieve a worthwhile outcome for the complainant.

  • Epping Forest District Council (23 001 466)

Statement Closed after initial enquiries Building control 16-Oct-2023

Summary: We will not investigate this complaint that the Council failed to take appropriate action against an outbuilding built by one of its tenants. This is primarily because we cannot investigate complaints about the Council’s management of its social housing, and the alleged faults have not caused the complainant a significant personal injustice.

  • Hertsmere Borough Council (23 008 869)

Statement Closed after initial enquiries Building control 15-Oct-2023

Summary: We will not investigate Mr X’s complaint that the Council was wrong to treat a dangerous structure on his land as an emergency and to carry out works to it without first giving Mr X the opportunity or applying to the magistrates’ court for permission. This is because the court is better placed to consider the matter.
