The Ombudsman's final decision:
Summary: We will not investigate this complaint about the complainant’s image being posted on Instagram. This is because the Council is not responsible for the actions complained about.
The complaint
- Mrs X complains about the Council taking her photograph and posting it to Instagram.
- She says this has caused her a lot of embarrassment as she usually wears a niqab and burka. She says officers should have told her before posting the photograph.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
- We cannot investigate a complaint where the body complained about is not responsible for the issue being raised. (Local Government Act 1974, section 24A(1), as amended)

My assessment
- The Council has advised that a housing association is responsible for the actions Mrs X is complaining of.
