Decision : Closed after initial enquiries
Decision date : 12 Jul 2026
The Ombudsman's final decision:
Summary: We cannot investigate this complaint about the Council’s actions relating to housing repair matters or its energy provider. This is because the law does not allow us to look at complaints about how the Council manages its own tenants and its properties.
The complaint
- Mr X wrote to us concerned because the Council had charged them for the cost of repairing or replacing items in his flat. He was also unhappy the Council did not tell him who his energy provider was, meaning he was not able to apply for the Warm Home Discount.
The Ombudsman’s role and powers
- We cannot investigate complaints about the provision or management of social housing by a council acting as a registered social housing provider. (Local Government Act 1974, paragraph 5A schedule 5, as amended)
How I considered this complaint
- I considered information provided by the complainant and the Council and I considered the Ombudsman’s Assessment Code.
Final decision
- We cannot investigate Mr X’s complaint because the law does not allow us to look at complaints about how the Council manages its tenants or their properties.
