Test Valley Borough Council (21 016 961)
Category : Housing > Allocations
Decision : Closed after initial enquiries
Decision date : 11 Mar 2022
The Ombudsman's final decision:
Summary: The Council has offered alternative housing via a Social Landlord, Miss X wishes to withdraw her complaint. Therefore, we will not investigate.
The complaint
- Miss X complains the Council declined her application in January 2020. She wished to be moved to another property.
- Miss X further complains the Council then accepted her application in January 2021 for the same reasons where she had previously been denied.
- Miss X complains the Council will not place her on their allocation list where she would have been had she been accepted in January 2020 and she has therefore been disadvantaged.
The Ombudsman’s role and powers
- We can decide whether to start or discontinue an investigation into a complaint within our jurisdiction. (Local Government Act 1974, sections 24A(6) and 34B(8), as amended)
How I considered this complaint
- I considered information provided by the complainant.
- I considered the Ombudsman’s Assessment Code.
My assessment
- Since making her complaint to us, Miss X has been successfully nominated for a new-build house.
- Miss X no longer wishes to complain as she will be getting the keys to her new property towards the end of the month.
Final decision
- We will not investigate Miss X’s complaint because she has chosen to withdraw it following successful nomination for a property she sees as suitable for her and her child.
