    Summary: Mr X complained that the Council has failed to take adequate action in respect of a large kennel erected in his neighbour’s garden without planning permission. He says he has suffered distress because of the daily noise and frustration at the lack of action. We found no fault on the Council’s part.

    Summary: Mrs X complains about the care her late mother (Mrs Y) received at the care home, OSJCT Langford View, arranged for her by the Council. The care home’s records do not support what it said to Mrs X when responding to her complaint. It also failed to record her daughter’s visit to Mrs Y. While this did not impact significantly on Mrs Y’s care, the Council needs to apologise for the distress caused and work with the care home to improve its record keeping.

    Summary: We have found fault with the Council for the way it reached its decision to refuse school transport for Mrs X’s son. This caused Mrs X the injustice of arranging transport for her son as her disability means she is unable to drive. The Council agreed to apologise to Mrs X for its error and reimburse Mrs X for the equivalent mileage allowance.

    Summary: The Council failed to make sure that Mrs B’s son received his full provision as set out in his Education Health and Care Plan. There was fault by the Council because it failed to review and amend the Plan in accordance with government guidance. The lack of support meant that her son failed his college exams and lost his apprenticeship. The Council has improved how it handles transitions for post-16 students, with a new dedicated team. It should also apologise to Mrs B and her son, and make a payment to recognise the impact on them both.

    Summary: Mrs X complained that the Council did not provide her child with education and the provision in their Education, Health and Care Plan when they were out of school. This meant her child missed out on a period of education. We have found the Council at fault for periods where Mrs X’s child did not receive provision. To remedy the injustice caused, the Council agreed to apologise, make a payment for loss of education and put in place some missed provision.

    Summary: Ms X complained the Council had not completed an Education, Health and Care Needs Assessment for her daughter and not provided an Education, Health and Care Plan. The Council delayed completing both. This has caused Ms X distress and her daughter to miss out on education. I have recommended a financial remedy.

    Summary: Mrs X complains the Council failed to ensure her child P received the special educational needs provision and social care support in their Education, Health, and Care Plan. There was fault by the Council which caused P to miss provision. This also caused distress to P and Mrs X. The Council agreed to apologise, evidence it is taking action to ensure P’s provision is in place, and pay a financial remedy. It will also review its processes for checking Education, Health, and Care Plan provision is in place.

    Summary: Mr X complained the Council did not tell him it was charging him for his care until a month after he had received the care. I have discontinued my investigation. This is because the Council offered a suitable remedy for Mr X’s financial injustice and we are unlikely to achieve a different outcome.

    Summary: Mr X complained the Council failed to properly consider Disabled Facility Grants he requested in 2022 and 2023. We found there was delay in responding on both occasions. We did not find fault in the handling of the 2022 application. We also found no fault in the decision to refuse the grant in 2023. However, we recommended the Council should apologise for the delays and provide guidance to staff about to ensure they applied the correct tests and explained the Councils decisions appropriately.
