Statement Closed after initial enquiries Trees 19-May-2026

Summary: We will not investigate Mrs B’s complaint about the Council’s refusal of her applications to do work to a protected tree. This is because it was reasonable for Mrs B to put in an appeal to the Planning Inspector.

  • Somerset Council (25 013 635)

    Statement Upheld Trees 13-May-2026

Summary: Mrs X complained about the Council’s poor handling of her high hedge concerns over a period of two years, which included delays to act on promises made in its complaints handling. The Council agreed it was at fault for causing delays and poor communication, and apologised. However, it has since failed to provide its remedy and progress her case. We found it had therefore continued to be at fault since November 2025. The Council agreed to apologise and make payments to Mrs X to acknowledge the frustration and uncertainty it caused her. It will also progress her case and carry out a service improvement.

  • South Gloucestershire Council (25 018 327)

Statement Closed after initial enquiries Trees 13-May-2026

Summary: We will not investigate this complaint about how the Council responded to a complaint about tree works. This is because there is not enough evidence of fault and any injustice is not significant enough to justify our involvement.

  • Birmingham City Council (26 002 630)

Statement Closed after initial enquiries Trees 12-May-2026

Summary: We will not investigate Mr B’s complaint that a Council-owned tree has damaged his fence. This is because this complaint is late and it is reasonable for Mr B to take the Council to court.

Statement Closed after initial enquiries Trees 11-May-2026

Summary: We will not investigate Ms X’s complaint about maintenance of a Council-owned tree near her home. There is insufficient evidence of fault to warrant an investigation. If Ms X considers the Council liable for damage to her property, this is better considered by the Council’s insurers or the courts.

Statement Closed after initial enquiries Trees 10-May-2026

Summary: We will not investigate Ms X’s complaint about maintenance of a tree near her home. The Council has told Ms X it is not responsible for the tree, as it is not on Council-owned land. If Ms X disputes this, the courts are better placed to resolve this matter. If Ms X considers the Council liable for damage to her property, this is better considered by the Council’s insurers or the courts.

  • London Borough of Enfield (25 014 926)

Statement Closed after initial enquiries Trees 06-May-2026

Summary: We will not investigate Ms X’s complaint about damage to her property caused by a Council-owned tree.
