- Mr X complains about how the Council responded to his concerns about rubbish dumped outside his house.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
- We cannot investigate late complaints unless we decide there are good reasons. Late complaints are when someone takes more than 12 months to complain to us about something a council has done. (Local Government Act 1974, sections 26B and 34D, as amended)

My assessment
- Mr X says his neighbours dumped rubbish near a bin outside his house in October 2024. He reported this to the Council and is complaining about its response.
- I will not investigate this complaint. Mr X complained to the Ombudsman in January 2026. This complaint is late because it is more than 12 months since Mr X first became aware of the issue. Mr X confirmed with the Council this was an isolated incident. There is no good reason to investigate this complaint now.

- We will not investigate Mr X’s complaint because it is late and there is no good reason to investigate now.
